Employment Law Compliance
There are laws that each state has to follow in order to have a business established. The type of business that is being established depends on the laws that need to be followed. After listening to the video chat with Bradley Stonefield, it has been identified that his goal is to begin a limousine service business in Austin, Texas where he currently resides. Bradley would like to have a small business with 25 employees to get started. As time goes on and business progresses, he will hire more staff according to the need of the business.
According to the laws and regulations to launch a business of this profession, Bradley has to consider the types of vehicles he would like for his business to have. This limousine business must also withhold the proper licenses in order to have passengers in specific vehicles. The number of passengers depends on the type of permit the driver is to have in the vehicle. If his master plan is to have limousine vehicles only to transport his passengers, than there is one permit that needs to be requested to get the ball rolling as this is only one step leading to the ending result.
The laws and regulations which Bradley has to follow are important and he must understand these laws in order to have a successful business. All Federal Employment Laws must be in place. These laws consists many topics under the United States Department of Labor. Many employees offer Health Care Insurance coverage allowing the employee to pay a percentage and leaving the remainder to be paid at the expense of the employer. From researching this part of this business, it seems Health Insurance is not mandatory to have at any place of employment. Bradley, as the owner of the business, should have knowledge about the United States Equal Employment Opportunity Commission Regulation as well as the Equal Pay Act 1963. All drivers that are hired in this business must have a valid driver license and withhold motor vehicle

    The article I chose to discuss was a court case involving the Emergency Medical Treatment and Active Labor Act (EMTALA). A Dickinson County hospital violated EMTALA for failing to provide emergency care for a patient who was transferred to a different hospital without being completely stable enough for transfer. In 1985, Congress passed the law of “Emergency Medical Treatment and Labor Act” also known as (EMTALA) to ensure public access and treatment to emergency services regardless of race, ability to pay, or legal status (U.S. Dept. of Health, 2010). This act states that all individuals needing emergency medical support should never be discharged or transferred until their condition is stable. This act also states that hospitals should then provide stabilizing treatment for patients with emergency medical conditions. If a hospital cannot stabilize a patient within its capability, the hospitals duty is then to treat the patient’s condition and in the event the patient needs to be transferred to become stable then a risk and benefit consent form needs to be signed by the patient. The transferring physician must also sign a certificate that explains the transfer outweighs the risks of not being transferred.
