A Case Study Of Bendigo
Some of Bendigo’s most vulnerable youth have been thrown an life line with pending opening of a new school through the department of education with the opening of a flexible learning centre, FLO.

This came about after a public outcry from teachers and members of the community rallied together to try and find an alternative solution after Anglicare’s
St Luke’s educational service unit pulled up stops, closing abruptly late last year, leaving students distressed. Anglicare have cited changes to government funding models as the reason for closing this valuable service.
This being the second blow to the bendigo community in a little over 6 months. On-Track Eaglehawk ran by FEO, another alternative education facility went into receivership

    Facts of the Case: The Appellant Miriam Leverington, a nurse at Memorial Hospital (Appellee 1) in Colorado Springs, was pulled over in December of 2008 by Officer Duaine Peters (Appellee 2). During the course of the stop Leverington told the police officer that she hoped he was never her patient. Officer Peters replied, "I hope not too, because maybe I'll call your supervisor and tell her you threatened me." The Police officer did in fact, within 5 days after the incident, report Leverington’s comment to Memorial Hospital. Leverington claimed that the officer had been rude and that she was just trying to communicate she hoped that she never had to interact with him again. Lower courts dismissed her case stating that her first amendment rights had not been violated. The decision went to appeals.…

    The legal fiction upon which Australia was founded refers to the British doctrine, “terra nullius”. The phrase translates to “land without ownership”. When Australia was founded, even though the colonisers acknowledged the presence of the Indigenous they considered the Aboriginals too primitive to be actual owners. The Aboriginals were considered too primitive with no identifiable hierarchy or political structure. This legal fiction had a significant impact on Australia with the widely known Mabo Case. In May 1982, Eddie Mabo and four other plaintiffs of the Murray Islands pursued confirmation of their traditional land rights in the High Court of Australia. Their claim had been that Murray Island (Mer) had been previously inhabited and had been possessed by the Meriam people with their own social and political organisations. After 10 years and the death of Mabo, on June 3 1992, the High Court ruled that the lands of Australia were not terra nullius when European settlement occurred and the Meriam people were entitled to the lands of Murray Island. Then in December 1993, the Native Title Act was produced as part of the Commonwealth’s response to the High Court’s decision to protect the native lands of Aboriginals. The legal fiction has therefore had a major impact on Australia’s legal history with the introduction of the Native Title Act where the Aboriginal and Torres Strait Islanders were compensated for the dispossession of their lands.…
