Do you believe American Airlines has the right to rescind a conditional offer? Why?
I believe that American Airlines has no right to rescind its decision despite the applicants having excluded their medical status. For a conditional job offer, an individual gets the job only when all the established restrictions are fulfilled by an applicant. Until the recruiting body is satisfied and assessed a prospective employee for all the requirements, one cannot claim to have acquired the job. In the presented case, a job was guaranteed on passing a background investigation, drug test, and medical exam. It is the right of the employer to choose a worker or not, but the actions can be challenged if unfair procedures to hire are used. On realizing the state of the three individuals, American Airlines withdrew the conditional offer, hence; the organization was cited for discriminatory practices based on the HIV status of the applicants in violation of the disabilities act. A proper selection process should be legal and fair to all the applicants. In the Americans with Disabilities Act, HIV positive persons should have equal chances with others not affected by the disease. Not only does the ADA forbid discrimination when hiring but also during promotions, interviews, and firing amongst other employment activities. The choice made when hiring should be based on how well anyone can perform given duties and not because the worker is too ill to offer their labor according to the assessment of the recruiting body. A company cannot assume that people living with HIV pose a threat to the workplace; rather, the employer must get medical evidence.
