Precedence which is defined as a document that would be used in determining a different case or your own case. A case that was used as a precedent in Duane Bucks case Buck v. Davis was one of his previous cases named Buck v. State. This precedence was used as a reference of the present case Buck is involved in because of the importance of a few different amendment rights. For example, the rights that Buck was appealing in court was his fifth, eighth, and fourteenth amendments that were violated during the duration of his trial. The Fifth Amendment says a person has the right to an impartial jury. The Eighth Amendment mentions that a person has rights against cruel and unusual punishment. Finally the Fourteenth Amendment which talks about promoted equality under the law and also defined citizenship. Those two cases were closely related in a way where those rights of every American citizen should have. Even though Duane Buck Committed the crime of killing his ex-girlfriend and her friend, he was only given some of his rights indirectly. Davis case has been looked upon over and over again to try to make sure they have all of the facts right. Not only will the facts about the double murder be discussed in the hearings and discussions throughout the court room but also about the appeals made by Duane Buck about his rights as an American citizen. Facts that were used in his original verdict may be taken away due to his fight over his rights. Federal Courts due to the falsely given rights to Duane Buck were turned bad when Buck responded to the final verdict made by the federal judge. If Duane Buck didn’t use his mind to notice that he wasn’t getting the rights that he should have in a fair way. This case also showed how bias and other influential ideas could represent away from the convicted individual without any chance of proving Bucks innocence. His assigned lawyer didn’t protect his client which caused a domino effect against his own life and future even though he did commit the murder of two
