Case Study: The Seattle School System
The Seattle school case and Gratz v. Bollinger were in fact colorblind. The Seattle school system didn’t want to become un-proportional in terms of race. Any school that became out of line with that would start to evaluate the race of students, trying to keep as close to 60-40 as possible. The court begins to question the fact the only thing being considered is the race of the students when putting them into particular schools. They believed it is not just about color, but about where the kids have grown up, what religion the child might identify with, their value system and so on and so forth. Although the school system wants to become more diverse the court also said there had to be a preexisting problem of racial bias along with a history

    Both the movie “Separate but Equal”, and the article “ How the Supreme Court Arrives at Decisions” by William J. Brennan, Jr., shows how the Supreme Court deals with issues, and what it takes for them to come up with a decision. It is a very complicated process because they have to be able to interpret the text of thee Constitution and come up with a ruling which so often can change a current law and affect every citizen in the United States. If they do not take the time need then it can be catastrophic for the country. In “Separate but Equal” all the justices had different views on the issue concerning racial segregation in public schools. Some of these views had to do with what state the Justices came from and what those particular states believed in and represented, and some felt that way on a personal level. Decisions like that should not be made based on personal preference or because of where you were born and raised. Because of these multiple opposing opinions, it was very difficult for the Supreme Court to come to a ruling on this case.     In the Plessy v. Ferguson case, people were believed that they were set free by the passing of the thirteenth and fourteenth amendments of the constitution, but little did they know, the government could always find a way around them. The “Separate but Equal” law took its way in the country. This allowed whites and coloreds to be separated without breaking the law. This is how they separated schools, restaurants, and even public transportation. Needless to say Homer Plessy lost the small battle in the court, but he was soon to change the government’s eye on such segregation based on one’s race and ethnicity. In the Brown v. Board of Education, the government looked over the old court case of Plessy v. Ferguson and saw that they did not go on what was stated in the constitution, that they went off the “separate but equal” doctrine, since it stated they were given equal and substantially equal facilities.     Brown v. Board of Education was a civil rights case, not a civil liberties case. A civil rights case is defined as the legal or moral claims that citizens are entitled to make on the government (Lowi 86). Once other correlation is types of segregation. The case of Brown v. Board of Education is considered de jure segregation. De jure segregation is a type of racial segregation that is a direct result of law or official policy (Lowi 111). Schools were originally separated due to the rulings of Plessy v. Ferguson (Lowi 109). Another particularly strong correlation is the connection to the equal protection clause. This was the provision of the Fourteenth Amendment guaranteeing citizens “the equal protection of the laws” (Lowi 108).
