Citizenship Waiver Process
A requirement to hold and maintain an Australian Government security clearance is that applicants are Australian citizens or that a citizenship waiver is in place. When I began as a Senior Security Officer with the Department of Immigration and Border Protection (DIBP) in 2013, one of my roles was to facilitate the Citizenship Waiver process.
At the time, there were approximately 100 waivers for employees of the department, which was one of the highest across all government agencies. I reviewed the appropriate policies and the current applications of the waivers in place. I identified that many of the employees were on their fourth or fifth waiver, which did not meet the requirements of the Protective Policy Framework (PSPF) and which could

Before David Neeleman’s non-compete agreement with Southwest Airlines expired, he envisioned the concept of starting a low-fare airline that would combine common sense, innovation, and technology and bring the humanity back into air travel (Gittel & O’Reilly, 2001). In 1998, JetBlue was born. In order for David to fulfill his goal of a “do-it-right” kind of airline, he needed to recruit superior industry veterans who were willing to start from scratch and place an emphasis on employees and customers. Each of these individuals, from the President, General Counsel, CFO, and the HR director, wanted to create an airline that was fun, had integrity, was safe, and cared for their employees, plus had a passion to get it right (Gittel & O’Reilly, 2001).…

The regulations allow employers to choose among four methods for calculating their employees ' eligibility for FMLA leave, but they do not specifically state how an employer indicates its choice. America West contended the FMLA 's implementing regulations do not expressly embody a requirement that employers inform their employees of their chosen method for calculating leave eligibility. The regulations nonetheless plainly contemplate that the employer 's selection of one of the four calculation methods will be an open one, not a secret kept from the employees, the affected individuals. America West failed to fulfill its obligation to inform employees of their choice for a calculating…

Employees of Given Company are expected to comply with all applicable local, state, and federal laws and regulations. Violations resulting from employee activities, business or personal, will not be condoned. Employees are expected to conduct all business activities well above the minimum standards required by law. Employees are expected to communicate all situational uncertainty with their direct supervisor and/or human resources director to ensure proper guidance and clarification. When in doubt, one should always waiver on the side of caution and seek advice, rather than make a choice that will leave a lasting impression on the reputation of the individual employee or the company as a whole.…

America West told Bachelder when it fired her that it based its decision on her sixteen absences since the January 1996 corrective action discussion (Walsh, 2013). If those absences were, in fact, covered by the Act, America West’s consideration of those absences as a “negative factor” in the firing decision violated the Act (Walsh, 2013). The regulations allow employers to choose among four methods for calculating their employees’ eligibility for FLMA leave, but they do not specifically state how an employer indicates its choice (Walsh, 2013). America West contends, correctly, that the FLMA’s implementing regulations do not expressly embody a requirement that employers inform their employees of their chosen method for calculating leave eligibility (Walsh, 2013). The regulations nonetheless plainly contemplate that the employer’s selection of one of the four calculation methods will be an open one, not a secret kept from the employees, the affected individuals (Walsh, 2013). This is where the airline made an error. The question remains whether America West adequately notified its employees that it had chosen the retroactive rolling “leave year” calculation method (Walsh, 2013). America West contends that, because its employee hand book states that “employees are entitled to up to twelve calendar weeks of unpaid FMLA leave within any twelve month period,” it provided sufficient notice to its employees that it uses the “rolling method” for calculating leave eligibility (Walsh, 2013).…

This memo will examine employment laws as well as how these laws are applied. I will also examine the penalties of noncompliance of the different laws. Employers who originally envisioned or understood that FMLA would be taken once, in its entirety when an employee had a child or provided caregiver services for a family member have found it difficult to adjust to the provision of intermittent leave and reduced schedules for the impact they have had on the workplace. When dealing with intermittent leave employers are experiencing some new dynamics with employees including keeping detailed and precise records on how much time has been counted toward FMLA as well as eligibility for FMLA. Employers wonder what accommodations to provide the employee, how to cover for an employee who may be spontaneously or sporadically absent from work and have even found themselves evaluating if they have a right to terminate an employee on intermittent leave. When employees use FMLA intermittent leave for their own medical ailments it sometimes creates suspicious employers who feel they have employees abusing the right to time off under FMLA and has caused some employers to resort to surveillance upon their employees on leave. Intermittent leave can be a complicated part of FMLA for an employer.…

The Fair Labor Standards Act is my selection for this paper because it has directly impacted my life. As a call center manager, I was deposed regarding a lawsuit claiming there had been a violation of the FLSA. As a potential witness in a pending lawsuit I am not allowed to give specific detail. The case is centered around a violation of the Portal to Portal Act of 1947 which was passed in response to court rulings regarding whether or not employees were due to be paid for “performing certain employment-related activities.” (Langston) Due to my involvement in this case, I developed an interest in the FLSA and this paper was an excellent opportunity for me to learn much more.…

Now that FMLA has been around for over ten years now, one would think that the administration of this law would be easy. However, that is no the case. There are primarily two reasons it is so cumbersome to work with. "First, the Department of Labor regulations are too voluminous. They are nearly 100 pages long and replete with inconsistent and unclear language. Second, the regulations are not integrated with the Americans With Disabilities Act ("ADA")." (Cohen & McLeod, 2003).…
