FLSA The employee does have a claim under the FLSA for his staying in shape because of the type of job it is. He should be paid back for all the hours he exercises because the job requires everyone to be fit and be able to meet the requirements of the job. If he would not exercise as much as he does then he risks being unfit for the department and for him to be able to keep up with the demands of the job. I also think the times that they have him on call he should receive overtime as well because while on call he cannot do what he wants that whole day because he has to be available for an emergency if one comes up. If he was working in a small market then no he would not be eligible for overtime as a police man on the swat team, this though seems like he is working for a larger market that should allow overtime for on call work and being able to exercise to remain fit for the job. The management should have time limits though for how much time can be spent exercising and how much overtime can be obtained. He has 36 hours of overtime just for exercising and that should be regulated so everyone can be paid the over time. Some things employees can do to avoid claims with the FLSA would be to regulate how much overtime can be had for exercising to stay fit so that everyone on the swat team can be involved. They may think that the salary they pay the employees should be enough to cover the extra time that they put into other things from being on call to keeping fit. This should have been talked about when they were first hired. They may also think that a police station does not need to give overtime because maybe the department is not large enough or because they just do not want to and require the employees to exercise on lunch breaks or other times off the clock.
