I directed Agent Sutehall and Agent Ensley to interview Paul Giering at his workplace.
I stayed to manage and help with the search and evidence collection.
7. Search the residence to locate evidence of the crime.
Residence Search
Prior to the commencement of the search, I directed Detective Kissinger to take photographs of the inside and outside of the residence. Once he completed taking photographs, the team searched the residence. Each room was assigned a letter to aid in systematically searching the residence (See figure 1.6). CVIP is also maintained by NCMEC to help identify children in child pornography cases. The CVIP report was sent to the prosecutor to assist with sentencing. The CVIP report shows how many of the submitted videos are identified series of a child victim. The court can then impose the suspect to pay restitution to the identified victims.
Sentencing
Giering is currently working on a plea bargain. At a minimum he will have to register as a sex offender.
SIGNIFICANCE OF EVIDENCE COLLECTED/NOT COLLECTED AT THE CRIME SCENE(S). The suspect’s (Paul Giering) computer had the user name “Test” and contained the type of video files that were located on Agent Sutehall’s initial investigation. An eMule file was also located on the computer. This evidence was supported by Giering’s admission to having at least 50-100 child pornography video files on his laptop computer under the user name “Test”. The evidence that was collected from the other occupant’s rooms, helped to eliminate them as suspects.
