Application case

A case of Racial discrimination?

Q1: Do you think MS Browne had basis for sexual harassment Suit? Why?
MS Browne sanders defiantly had the basis for filing sexual harassment suit , As she was fired for no apparent reason specially according to one of the reports that there was no confirmation of her performance being subpar and Gardens claim of her sub standard performance only raised when she plea her case before the court .Moreover the system which was in place at Madison square garden was inadequate where employees could not file their complaints through proper channels and adding unresponsive behavior of management to other things left her no choice but to take legal action against them .

Q2 : From what you know of this case , do you think the jury arrived at the correct decision ? If not why not ? if so , why?
By looking at the overall picture of the case where we have come to understand that Madison Square Garden could not able to provide sufficient evidence to back their claim that Ms Browne’s termination was not wrongful. More so reports of repulsive and unresponsive behavior from the management specially after filing complaint to the top management puts Garden ‘s in a narrow hole and unreasonable comments coming from Thomas also gives jury reason to believe that in this case real culprits are the management of Madison Square Garden and reached verdict by the court in light of provided evidences and circumstances is the most appropriate one.
Q3: Based on the few facts that you have , what steps could Garden management have taken to protect it self from being a liability in this matter ? In this case of racial discrimination and retaliation where Madison Gardens Square was bluntly hurt by bad publicity is lesson for all those organizations who allow factors as this to grow in their organization. The most obvious answer to this question would be that they

    3) The judge has made a judicial error by allowing the Plaintiff 's counsel to comment on the case about Minichiello 's boss being a German with an "attitude of hatred" and made forced analogies to Nazi Germany and the Holocaust. The judge also allowed irrelevant testimony, which asserted that the Club discriminated against Latinos, Jews, and African-Americans, to the issue of discrimination based on sexual orientation. I agree that awarding $20,000,000 was grossly excessive and has no rational basis, and was an error by the judge as well.…

The IAD investigation determined that there was no basis for Williamson’s allegations. Williamson sued the City of Houston under Title VII of the Civil Rights Act for hostile work environment sexual harassment and for retaliation against her for reporting the harassment. In a District Court, a jury found the city liable for both sexual harassment and for retaliation. Williamson was awarded back pay and compensatory damages, as well as court costs and attorney’s fees. On appeal to the Fifth Circuit, U.S. Court of Appeals, the City of Houston challenged the judgment on the grounds that it did not have notice of the harassment until April 1992 and that her notification to her supervisor should not have constituted notice to the city. The District Court’s ruling was affirmed by the Appeals Court. 3. Main Issue: Can a supervisor’s knowledge of harassing behavior be imputed to the city to show that the city knew, or should have known, of the harassing behavior and can therefore be held liable for failing to stop the behavior? 4. Court Deciding: United States Court of Appeals, Fifth Circuit. 5. Decision: Summary judgment affirming the decision of the District…

STUDENT ANALYSIS I am in agreeance of the final decision. Since Ms. Palsgraf sued for negligence of the guys pushing and pulling the man with the fireworks, she shouldn’t win. This is because the employees had no idea of what was in the box. I understand why the first two decisions went in Ms. Palsgraf’s way. She was injured so the courts wanted to grant her some money for her pain and probably emotional…
