Known as direct-to-consumer pharmaceutical advertising (DTCPA), new information is showing these could be more harmful than beneficial. Marketing of these drugs, unbeknownst to consumers, often takes place before information of long-term safety is known. Furthermore, patient’s views of doctoral qualifications can be undermined if the practitioner fails to prescribe the requested medication. Arguments for the benefits of DTCPA are often outweighed by the harms they cause. The Workers' Compensation Law seems clear in requiring that every employer insured under this Law should have a safety program which "shall" include a written drug and alcohol testing policy which complies with Miss. Drug testing is become increasingly popular tool used by business ' today to weed out the potential employment candidate that may have drug problems. This testing does not determine whether a potential candidate has any issues with alcohol abuse, but will help a company determine whether or not the potential employee might be using other substances, such as prescription pills or illegal drugs. During our DAPA inspection, the inspectors did not provide us with the grade due to we did the inspection a week before the actual CAV inspection. They did find minor discrepancies which were corrected on spot ( instruction not in the binder, alternate DAPA designation letter not in the binder etc..). The only discrepancy that was outstanding at the moment was CO and XO ADMITS access. Also, the Wing came couple of weeks after the inspection to verify CO's/XO's ADMITS access which they had. The biggest issue with people having a drug problem is being disqualified from employment for drug abuse. Drug testing applicants would further help someone who may need help but doesn’t know how to get clean, or the right direction towards the correct help they need to stay free from drugs. Being free from drugs would then help someone not need welfare because they would be able to get a regular job in the work world, thus saving the government more money in the long run. GINA says an employer cannot even ask for or buy genetic information from its employees. For Human Resource representatives the GINA clearly states for regulations for genetic information. The need for a genetic test is very limited to the health care professionals and tests for drugs must not be a DNA establish test it must only test for illegal drugs. My recommendation for GINA is to establish testing with a trustworthy health facility if drug testing is to be done. Have in writing what is being tested and what is not so the employee is aware what is occurring with their sample. Have in writing what the current health care insurance can and cannot require from the employee and do business with an established insurer. Advocates claim that employers have every right to expect their workers to be sober on the job, especially when safety and security are on the line.
