The nature of Faden’s video is fairly calm and doesn’t provoke a sense meanness or would leave a bad taste in the viewer's mouth from disney. At the end of the video the phrases said by the characters can be considered a little …show more content…
rude and can impact a viewer's decision on buying the products use in the video by very little. Faden didn’t use the clips to impact a viewer's decision on buying the product. Faden used the clip tell the viewer about copyright and fair use and did use any of the movie’s plot to teach the viewer.
The amount of the product used in Faden’s video was well within fair use guildlines with using clips that lasted less than 3 seconds each.
In the case SOFA Entertainment, Inc. v. Dodger Productions, Inc A seven-second clip from the Ed Sullivan TV show was used in a staged musical history based on the career of the musical group, the Four Season. The judge wrote in the ruling that the clip was a short clip and it transform the work to take new meaning. so Less than 3 seconds is well within the amount that can be used for fair use and the work transform the meaning of the original into it’s own idea
The effect that faden’s video could have on the market is nothing. Faden is not making off it only the company that publishes the dvd. But since the video can be found on the internet for free. The amount of revenue the Dvd sales bring is next to nothing. So Faden’s work is not infringing on copyright in any way
In collusion I think that Eric S Faden and his video “A Fair(y) Use Tale” is well within the rules for fair use. It made the clips use stand for a different purpose than the original. The clips that were used were really short about 3-5 seconds each. The video would have no effect in the market since it is available for free on youtube and other video sharing sites. The use of the video was to teach other about Copyright and fair use in fun way. So I think this video fair
use.
