Making A Difference In analyzing the ethical dilemma in this case, I take cognizance of the environment in which my organization operates and I understand that the moral standards of behavior differ among individuals. I also recognize that moral problems in business are complex and difficult to resolve. I employed the application of Hosmer’s rule in my analysis of the ethical problems so as to reach an objective decision. The question arising from this case can be viewed and analyzed in two different dimensions. Both dimensions would however reach the same or similar conclusions. Why do I have to sign a document realizing that some of the fund is going for bribery? One dimension of analyzing this is to assume the whole decision making process is based on my appending the signature on the document – and not subject to further questioning. Another dimension is that even if I append my signature, the project is still subject to further testing and approval. Based on the premise that the road project will not executed if I do not sign the inflated contract document, and choosing not to sign, some groups are going to be hurt or harmed in ways outside their control while others will be benefited or helped. The right and benefit of residents of Maryland local government area to have their roads constructed will be denied. Even, delay in implementing this project will hurt this group. The construction company, ABC will also be hurt by losing the contract. The Federal Government (representing the larger society) will benefit. If I choose to sign the inflated contract proposal and the project is executed, the residents of Maryland local government will have their rights recognized, the construction company, ABC Engineering and the government officials in charge of approving the payment will benefit. I and the Board of Trustee of LGMSPA would have committed a wrong. The larger society will be hurt

    D.C. McClain, Inc. entered into a contract with Arlington County to build a bridge. A major portion of the project was installing post-tensioning pre-stressed concrete, which required securing an easement from Westfield Realty, Inc. for eight feet of land behind where the bridge was to be built. This request for an easement was denied on February 15, 1988. McClain executed the contract on March 16, 1988 to construct the bridge for $789,755.90. VSL, the subcontractor hired by McClain to perform the post-tensioning, developed an alternative to the post-tensioning that involved creating blockouts in the bridge. Mechanical equipment would then be placed in the holes created by the blockouts to post-tension the bridge. This method failed due to the temporary shoring, which was used for support before post-tensioning, would not support the bridge. McClain encountered other problems during its attempt to construct the bridge, resulting in all work being put on hold. McClain and the County executed Change Order No. 4, requiring the County to pay an additional $365,000 to McClain in return for McClain’s agreement to finish the project by July 1, 1990. This additional payment would constitute “full compensation” for the remainder of the work on the bridge. A few months after Change Order # 4 was signed, McClain informed the County he could not complete construction on the bridge unless the County would pay an additional $180,000, and obtain the necessary easement. The County refused and sent notice to McClain of their intent to terminate the contract. The contract was terminated on July 20, 1990.…

    If the project is completed on time then there is no risk for completion. All of the regular risks that apply to a project built on time apply to this one regardless of whether you are building a new infrastructure or modifying an older one. If the project is finished one month early, the quantitative risk really does not exist. It is basically comparable to completing the project on time. Since the project is quoted at 3 million dollars it will stay the same regardless of how fast the project is finished. However, you may see differences. When you rush a project this large you could possibly cut corners or receive poor quality results. If the project is finished two months late there are additional risks. If the company expects to make $20 million dollars annually, and assuming that the 4% penalty is levied against this yearly figure and not within smaller period of time, one month late means that US Industries Incorporated loses $800,000 annually. There doesn't appear to be any additional risk, however, further penalties and the possible eventual loss of the contract to a competitor could result in a poor product. There again appears to be no real quantitative risk involved if the project is finished a month early with the security requirements. If the originally quoted $3 million dollars remains the same regardless of how fast the project is finished and not coupled with hourly or daily wages, then there is nothing to lose financially. However the companies go beyond the required 1.5% completion benchmarks that the contract demands. Rushing a project of this scale also comes with rushed results possibly cut corners or poor quality. The credibility of the company is at stake with such a high profile, high income project such as this, and it is important to use all of the time available to ensure the best product is on display for any customer.
