ETHICS CASE
A company which has recently been cited for state environmental law violations is seeking a variance from a state environmental regulation because the cost to comply would be very high. The company plant is in need of modernization. Engineer A works for the state environmental department and has been assigned to review the variance request. Engineer A is very experienced, having worked on the original regulation as a technical expert, and he is also familiar with industry practices and operations.
Following a review, Engineer A makes a preliminary recommendation that the state environmental department decline to issue the variance, and he informs the agency head, who is not an engineer, of this matter. Following a meeting between the agency head, and the company, the agency head directs
Engineer A to issue the variance. Part of Engineer A’s responsibility will be to testify at the state pollution control board hearing describing the technical grounds for approving the request.

What are Engineer A’s obligations under these circumstances?

Environmental law is the important part of government regulation and it deals with pollution or contamination problems. In our case contamination is found within the walls of the factory that was owned by W.R. Grace & Co. Company was using hazardous substances and it has legal duty of care for waste: they had to be disposed or recovered (Business Gateway, 2009). But company failed to do that and all waste was poured out into the water. Unfortunately those burdensome substances negatively affected health of large number of people including workers of the factory, their families and neighbors who lived in the Woburn, Massachusetts. “Ingestion” occurred as people were drinking this polluted water and they were using it for cooking. That region was characterized by large number of illnesses and sick people. Unfortunately contaminated water became the reason of death of children, who died from leukemia. According to general obligation law to environmental contamination caused by businesses, company must pay compensation if its manufacturing processes resulted in contamination and this pollution in its turn caused the personal injury or property damage. (Nelson, 2006) But in our case exposure of hazardous substances in the water resulted in deaths of children and there was no amount of money that can revive and return them to their parents. But someone had to take responsibility of it. This case presents a very typical situation that people encounter while working in the corporate environment. What is ethical, what is morally correct and what is just right out against the law are the questions that we all face while working in a corporate environment. Some of the ethical questions are governed by the law facing the situation. For example while working in an investment bank you most probably have access to inside information about upcoming deals that one could possibly use for personal monetary gain or you could act as a tippie and possibly share that confidential information with others. This kind of a situation is definilety governed by the law and you can actually be charged with various insider trading laws and possibly do some jail time as well. The other situation that is presented in the case is purely about ones ethical and moral standards. The analyst either has to compromise her loyalty towards her company B&B or towards her best friend Lori. While the situation presented is not a real zero-sum game, i.e., one player’s loss does not equal to the gain of the other player. When faced in a situation like this one has to think about what decisions can be made that will have the least affect on the players involved. The analyst should not look at the situation she faces as black or white. She should rather think about other options she might have to retain her friend’s loyalty while not compromising her loyalty towards her current employer. For example, Lori has already been laid off by her current employer, Universal group. The Universal group has already broken certain ethical and moral laws by not informing about the situation to B&B. So can the analyst come up with a situation where she can get Lori immediately and legally hired at B&B and convince her to share the information with B&B.
