An express warranty is an oral or written advertisement of goods. In 1914 the federal government authorized the Federal Trade Commission (FTC) to prevent “unfair and deceptive trade practices. Yes, an express warranty was given that could possibly be used to recover Lawrence Dorneles’ money. I believe this because the ad stated that the car was in great shape and that almost every part had been replaced on the car implying that the car had not driven much.
In An implied warranty is a warranty of merchantability is a written or verbal statement that states the item or product that is being sold is fit for the purpose in which they were purchased. Unless the item is sold “as is”, this means the seller is not liable for anything that happens
