We need a better eyewitness the problem is the Memory. When rape accure the defant is
in a stay of frightening situation and her mind is going a thousand mile per hour that she grasping for her life and doesn't know if she live or die so her memory won't last because she is full of stress and taking mental shoots of the perpetrator it would be easier if the perpetrator had a tattoo then she could be sure who was the perpetrator was. So much adrenalin is rushing through her body that it would be difficult to identify the perpetrator in line up because now the have light on the subject and facial features different in the light and usually she would be unsure and would guess which one in a line up."Double-blind, Instruction to witnesses, Multiple lineup procedures, Feedback to witness, Simultanous versus sequential lineups, Composite proceedures, Stress, Witness focus on the weapon, Duration of event, Distance and lighting, Witness character, Memory decay, Cross-racial bias". (Criminal Evidence Thomas J Gradner pg.320) Are just some of the systems that the defant is experiencing, and it sound be brought up in court and dismiss in the court room. There for we can never trust the eye witness conviction.
What are they doing to change this. The "United State Judges, prosecutor, defense lawyers and law enforcement officers are being made aware of, and instructed in, the hazards inherent in collecting, processing, and using eyewitness testimony in criminal prosecutions." (Criminal Evidence Thomas J. Gardner pg 322). So the law enforcement will look harder for evidence so more warrants will be served. "It is likely that the courts will permit more expert testimony on the hazards of eyewitness identification." (Criminal Evidence Thomas J. Gardner pg 322). So we will become more scientific and Forensic is always growing and they are find more and more evidence and different ways to collect information to crime scene. "Corroborating evidence is important in eyewitness identification cases, and law enforcement officers are working harder to obtain evidence bearing on the reliability (or unreliability) of eyewitness testimony." (Criminal Evidence Thomas J. Gardner pg 322). So we will look at search warrant used more often to go through the house collecting evidence and the car
