Supreme Court of the United States had decided to hear arguments in two gay-marriage cases, one is Defense of Marriage Act (DOMA), and another is Proposition 8 (Prop 8). The case will be tried in 2013, and the court will issue its ruling in June.
The Defense of Marriage Act is a United States federal law which signed by Bill Clinton in 1996 restricts federal marriage benefits and required inter-state marriage recognition to only opposite-sex marriages in the United States.
Another one, Proposition 8 was a California ballot proposition and a state constitutional amendment passed in the November 2008 state elections. The measure added a new provision to the California Constitution, which provides that “only marriage between a man and a woman is valid or recognized in California.”
These two cases will have big influence on whole America, so everyone has to know about what results might be.
The first result might be both of two cases were sustained by the United States Supreme Court. Homosexual marriage is still illegal in California, besides, do not recognized by Federal Government of the United States.
The second result might be Prop 8 is unconstitutional. If this is truth, legalizing homosexual marriage will immediately take effect.
The third result might be Prop 8 is unconstitutional and it is applicable to every state. Thus, homosexual marriage can be hold in whole America.
The forth result might be DOMA is unconstitutional. Then, Federal Government of the United States will recognized homosexual marriage, and also can have same benefits as heterosexual marriage, such as inheritance-tax relief or the right to file joint tax returns.
