How Did Mr. Brrenner Convey A Duty?
Again, thank you for meeting with me regarding this matter. I assure you that we will handle this matter diligently. Mr. Green your concerns were whether Mr. Brenner’s words and actions create a duty and did he owe duty to you. Based on the information that you provided, there are some facts that makes it difficult to prove that Mr. Brenner owed a duty and had a duty to you. If the promise is not kept and a negative situation occurs then one can be liable for failing to provide a duty. I understand that Mr. Brenner stepped in and offered take you to the ER after Mr. Jones already committed to transport you instead. Mr. Brenner words were “Don’t you worry, guys. I’ve got this” because Mr. Jones lived far from the ER. However, the problem is that the promise was not made directly to you because you were unconscious. There needs to be evidence to support that you that a promise was made to you and that you relied on it. You mentioned that Mr. Brenner stated that he would take care for you could helpful when establishing a duty. Mr. Brenner’s statement could be viewed as a promise that you relied on since he told you that directly. His failure to take care of you is what led you to fall from his balcony.
