HOW A BILL BECOMES A LAW
-if senate legislative committee approves a bill, that bill is sent to the senate majority leader and minority leader who negotiate a unanimous consent agreement to determine length of debate of a bill on the senate floor and how many amendments can be offered
-if ONE senator disagrees, then there are no rules for debate (other than general parliament procedure
-if no rules- no time limit/ amendment limit – filibuster occurs (when one senator or a group of senators keep talking to control senate floor until supporters of a bill give up- the purpose is to prevent a vote on a bill)
-long, one person filibusters are rare- longest one was in 1957 when a senator spoke for 24 hours straight on a civil rights bill to make it slightly easier for blacks to vote (Strom Thurmond) last one person overnight-1992
Group Filibuster- common, actually typical and lead to non-ending filibusters until supports of the bill give up and withdrawal bill
HOW TO END A FILIBUSTER: 3/5 vote (cloture motion)- 60 senators if it passes, limits further debate to 30 more hours
-since 1979 neither democrats nor republicans have had 60 or more members in the senate- except for 6 months in 2009 (obamacare)
group filibusters started in the 1990s when Clinton became president, and senate repubs began to group filibuster most bills supported by majority democrats- has gotten worse in the last 20 years so that the minority party group filibusters anything significant supported by the majority party
FOR 6 MONTHS in 2009- there were 58 dems and 2 independents in US senate, allowed obamacare to pass because all 60 voted for cloture when republicans filibustered, this is why the bill turned out to be a mess
