Human subjects on research attract supporters and opposes in equal measure. Although legal and political players have their input in the whole debate, socio-cultural and religious opinions take a center stage in this subject matter. The medics have an obligation, therefore, to analyze, evaluate and strike an acceptable balance. Despite all the efforts of healthcare providers to ensure an Individual receives the best possible care there might arise conflicts and dilemmas between healthcare worker & service user. Those conflicts may include: refusing a meal, type of activity, refusing medication or a treatment. Arising conflicts should be resolved as quickly as possible in a most satisfactory manner for both sides. The Human Rights Acts states that every person has the right to decide about their own life, they can refuse the treatments & medication they receive. The ability for a patient to deny life saving medical treatment relies on two necessary conditions being meet. Firstly, the patient must be competent. Secondly, a paternalistic model cannot be used for the patient’s treatment. This places almost all of the power of decision away from the patient, thus limiting the right of patient autonomy. If the necessary conditions are met, the sufficient conditions of patient’s refusal of life saving treatments must be an impairment of their quality of life along with expressing a desire to deny treatment. When these conditions are fulfilled, a patient is within their rights to refuse live saving medical treatment. The case of Dax Cowart reflects why these conditions are needed for morally just refusal of treatment.…
This article present a case in which the patient and the family made a decision in favor of resuscitation that ran contrary to the physician’s medical judgement. The author argues that, where a patient request for treatment in conflict with physician’s responsibility to provide what he or she believes to be good medical care, a resort to autonomy alone is insufficient. The principal of autonomy, which allow patient to refuse any procedure or choose among different beneficial treatment, does not allow them to demand nonbeneficial and potentially harmful procedure. This is important because CPR should not be considered an alternative to be offered by physicians in such cases. Instead, the physician should have listened to the patient’s hopes and fears, reassured him that the physician should would continue to be there and provide appropriate therapy, and, if necessary, refer the patient to psychiatric personnel or clergy.…
While working in care, the aim is to give the best possible standard of care to service users, but sometimes there can be a conflict beetween the individual’s or their family’s wishes and rights and the duty of care. In this case the most important thing is to decide whether the person is aware of the risks and consequences of the decision and has the capacity to make the decision. Before taking best interest decisions I have to make sure that the person definitely lacks the capacity. The person or their next of kin has an overall right and responsibility in decision making for issues relating their care, and I need their consent to deal with certain issues. At many times, patients come in unconscious or with altered mental status. Many patients come in with major injury or trauma. When trauma comes in the nursing staff has little information about the patient. In a lot of cases, the nurse has very little time to gather data about the patient coming into the ED. Nurses have to perform invasive procedures without consent. Some patients require CPR and later the staff find the patient was a DNR. Even though the outcome was not what should have been, the nurse has to reflect beneficence, what is in the best interest of the patient, do good for each patient in their care.
