JASTA is bill that allows civil claims based in the U.S territory and borders against foreign countries for the liability of terrorism acts which foreign state is sponsoring directly or indirectly, resulting in either personal or property damages. The congress considered the JASTA act as a claim to compensate families who were injured by the 9/11 attacks.
The main purpose of the act is to narrow and limit the immunity of foreign states in cases where international terrorism acts might arise.
However, the U.S did not keep in consideration the consequences of this bill; most of the countries around the world have suffered many damages, such as death of family members, physical injuries, psychological damages, …show more content…
trespass, loss of lands and the sole perpetrator was the American Government and its officials. A great example, of the violence and aggression of the American Government is the act of torture in Abu Ghraib prison, and this is one amongst many injustices caused by Uncle Sam.
Therefore, implementing such an act will have an adverse effect on the U.S; countries that have been victimized will have the right to pursue legal actions against the U.S Government for criminal and tortuous conducts incanted by their citizens, employees, agencies, organizations and army. The JSATA also incriminate all sorts of financial aids to terrorist groups. Thus, the U.S Government will be subject to liability. In my opinion, sovereign state cannot exercise authority on another equal sovereign state, because the hierarchy that is found domestically is none existent in the public international scope.
Even after mentioning the above, according to the 9/11 commission report; none of the evidence found indicates that Al Qaeda was funded or supported by any other foreign country, the sponsoring funds were all transferred through American transactions only. Even though the federal court has the jurisdiction to resolve the disputes between the injured families of 9/11 against the sponsoring foreign countries, the U.S has already admitted that foreign countries were neither sponsors nor liable for the attacks
Moreover, Ash Carter who is also opposing the legislation of the bill is stating_ indirectly_ at Capitol Hill in Washington; that the loss of 28 pages will raise questions concerning the responsibility of the U.S Government in these attacks and will disclose their secrets to public.
To conclude, the implementation of JASTA law contradicts with 9/11 commissions, the principle of the sovereign equality and shows the malicious intentions of the U.S Government and as a result JASTA law will affect the sovereign immunity of the U.S
itself.
