The cased being studied in this article discusses the occurrence of the military officer, John Doe, who is reported as an alleged abuser of his 13 year old daughter, Mary Jane. The allegations of physical abuse occurred on a Sunday afternoon when John Doe was at home on leave. He instructed his daughter,Mary Jane, to do her homework after she helped with preparing dinner. She was given an hour to complete all her homework without any mistakes. When NCO Doe came back to check on her she had not yet completed her homework and was watching television instead. John Doe decided to give her another chance of 30 minutes to complete the assignment. One the second attempt he found her still watching television and instructed her to turn it off and to continue with her homework. When NCO Doe came back for a third time, Mary Jane still had not completed her homework. …show more content…

He then turned off the television and ordered her to go to bed. Mary Jane went to school the following day with a subconjunctival hemorrhage in her proximal eye. The teacher, Mrs. Jones, noticed Mary’s eye and asked what happened to her left eye. Mary elucidating to Mrs. Jones that her father had slapped her in an impulsive manner. Mrs. Jones immediately contacted the CPS and made a report of child abuse. NCO Doe was arrested by the local police for child endangerment and CPS filled a report because of the allegation of child abuse. Medical evaluation was instructed for Mary Jane. The results from the physician are included in the article. Besides the CPS investigation, the military also did an investigation and determined that there was no full evidence of child abuse.     The legal issues in this case involved the treatments of Petty, a former Police Officer who left the Metro Police Department for active duty with the United States Army. Upon his request to be reinstated, Petty was not placed in his original position as a patrol sergeant or a similar position based on the completion of the return-to-work form n which he did not disclose all the facts regarding his discharge status. The police department return-to-work process is a policy that is required for all officers to complete if they were away for an extended period of time no matter what the reason for their separation. One of the questions on the personal history questionnaire Plaintiff filled out during the return-to-work process asked: “During your absence were you arrested, charged, detained, or a suspect in any criminal action or military disciplinary action for any reason or do you have any action pending? If yes, explain in detail (use back if necessary).” Petty answered “Yes.” He also attached a narrative explanation of his response in which he admitted facing military charges in Kuwait. The narrative description did not disclose: (1) that Petty was accused of giving alcohol to an enlisted soldier; and (2) that Petty was accused of manufacturing alcohol. Since Petty did not mention facing military charges for manufacturing alcohol while in Kuwait, he was assigned to desk work. (Walsh, 2010, p.348) Under the Uniformed Services Employment and Reemployment Rights Act (USERRA), as stated in chapter 11 page 346, employers are prohibited from discriminating against member who serves in uniformed military services.     Another story on an AWOL soldier is when first arriving to Korea a SPC by the name of Jalen Davis, got in trouble for multiple violations such as fighting, drinking on duty, and sexting on a government phone. Davis was demoted to PV1 and received multiple ART 15's as punishment. He was also waiting for chapter paperwork to be approved. The next day after his chapter paperwork is approves starts out processing but never returns. Davis disappeared for two days. Davis was now an AWOL soldier. He went down town to a Korean hooker that he was in love with. Davis was out of money so when he went back the next day the girl called his 1SG to come get him. They locked up his civilian clothing thinking that would stop him for leaving, but he got away again.     Woodward worked as an au pair to a baby boy named Michael, and when he suddenly stopped breathing one day she rushed him to the hospital. Later, when he died from what was diagnosed as Shaken Baby Syndrome, Woodward ended up being accused of violently shaking him and causing his injuries. This article focuses on the fact that there was so much emphasis placed on the Shaken Baby Syndrome triad of symptoms in this trial, and the overall divide in the medical world on the topic of abusive head trauma. Dr. Patrick Barnes, who testified in 1997, reveals that Woodward’s trial made him rethink what he knew about abusive head trauma.
