Diagnosing MSP is very difficult because of the dishonesty that is involved. Doctors and all healthcare personnel must rule out any possible physical illness as the cause of the child's symptoms before a diagnosis of MSbP can be made. So, if we know about any child who had a history of medical conditions and injuries should we report to authorities for…
Medical malpractice is when a doctor or another medical professional, such as a nurse or technician, does something or does not do something that causes an injury, harm or death to a patient. In the U.S., experts estimate that about seven in every 1,000 newborns suffer a significant, traumatic birth injury each year due to medical malpractice. Those injuries include, but are not limited to, autism, cerebral palsy, as well as Erb's palsy. According to Donald H. Beskind, a professor at Duke University School of Law, juries are typically influenced by three main factors when deliberating on malpractice cases: the degree to which it is clear who was at fault for the negligence, what money would do to improve the plaintiffs' quality of life, and…

There are many challenges that are faced daily when becoming or being a mandated reporter. Questions are always asked within one self what the right steps are in taking precautionary measure in protecting a child from harm. I myself feel as a childcare provider a child’s safety is much more important than anything in this world. Mandated reporters are individuals and professionals who are required to have a report made when, in the ordinary course of their employment or profession, they have reason to believe that a child under the age of 18 has been abused, neglected or is placed in a risk of serious harm by anyone which can include guardians or even staff members of their own establishment.…

A child/young person has the right not to be subjected to repeated medical examinations or questions following suspected abuse. Children should contribute their own account of their own views, they should be listened to and within certain circumstances these should be applied, but when a child is in significant harm then you would look at the child’s best interest to make them safe.…

In this report, Hardesty was charged with physical abuse which is purposely hurting another person’s body. This is because it wasn’t an accident that she punched her patient’s body leaving a bruise if she would punch her every time she enters her room. Furthermore, because the nursing assistant actually touched the patient who didn’t want to be touched and injured her, Hardesty could also be charged with…
