Chou and BTT reach the point of having a contract when they agree to all terms. In the email send by BTT covering the obligations of the parties and the terms of the agreement, BTT showed objective intent. If there was a contract between Big Time Toymaker (BTT) and Chou it was a bilateral contract that was binding when BTT (offeror) paid Chou (offeree) $25K in exchange for limited negotiation privileges for a 90-day period. Consequently, BTT bought the rights to negotiate the distribution agreements for Chou’s board game. A bilateral contract is an agreement of two promises and two performances. The agreement stipulated that at the end of the 90-day period, there wasn’t a distribution agreement unless it was in writing. Considering that an oral contract may result in a binding contract it is my assumption that there was a contract for the 90 day negation period with the exception of the distribution.…

Volunteering at the SOAR agency was one of the coolest experiences I have ever had. I will be honest though, when I was first assigned the service hours I was not too thrilled about it. I had never worked with individuals who had disabilities before. I had been around them, but never worked or volunteered with them. Learning about all the disabilities in class was one thing, but actually going out and interacting with the people was another thing. I was very nervous to say the least. But looking back on it, I could not be happier about it. I am glad I got this opportunity.…

They are different types of and legal protections of intellectual property. There are Copyrights, Patents, Trademarks, and Trade Secrets. Copyrights protect original works of authorship, such as literature, music, artistic works, and computer software, for example plagiarism, or use of music with in a game or music without the owner’s permission. As the holder of a copyright you have the exclusive right to reproduce, adapt and to distribute the work. Patents grant the rights on inventions, allowing the patent holder to exclude others from making, selling, or using the invention. An example would be the as seen on TV items you won’t see the item on shelves at Wal-Mart until patent runs out and other companies are allowed to make it. Trademarks are words, phrases, symbol, or designs that distinguishes the item from other competitors, such as Nike. Everyone can distinguish Nike product by just the Swoosh symbol. There is also Trade Secrets, which is a formula, process or device or any other way that keeps a company’s secret to give them an advantage. An example of a trade secret is Coca Cola. Their formula has been kept secret for decades, they have taken the necessary steps to control disclosure of the information (upcounsel.com). the law steps into place when any of these are filed with the federal government, such as the US patent office. They can provide protection from other competitors using your ideas. They can provide an attorney if needed. An e-company can benefit from any of these types of protections from the government, especially the Federal Trade Commission, depending what they offer. An example being Amazon. They fall under almost all of the different intellectual properties. Copyrights, being one of the first companies to offer online sales of anything needed except what is considered illegal. Trademarks…

In intellectual property is necessary to give one the right to protect and own his work with the arrival of the digital age it has become much harder to remain in control of a person’s intellectual property. This is because the intellectual property rights no longer protect exclusively the interest of preserving a trade secret but is now interested in preserving the monetary gain of a person. Regulation of product safety majorly involves the consumers act which aims at providing quality and healthy products to…
