Building information alone could have easily been used to protect their employees once Metro-North exercised their due diligence before taking on a job site. Once a job site tested positive for asbestos Metro-North must inform their employees of the presence and what areas tested positive as well as which building materials (Metro-North Commuter R.R. Co. v. Buckley). If a job site test above asbestos limits, Metro-North needed to make a determination that any job connected with specific materials cannot exceed asbestos work conditions and concentrations levels. Ensuring employees have the best possible equipment to protect them from exposure as well as monitoring the air quality in the work area to limit airborne exposure and air quality.
Employees working in exposed areas need to be medically monitored to measure and protect them from any possible exposures that can be quickly identified. Even though consistent medical monitoring is not cost effective in the short run, however, the long term provides employees with a level of comfort.
