RE: NON-ENGAGEMENT

Dear Mrs. Togstad:

Thank you for your interest in our law firm. As we previously discussed when you came into our office December 27 2013, I needed to do some research before accepting to represent you and your husband in this case. At this time I would like to inform you we are unable to represent your husband or yourself in this medical malpractice matter. After reviewing your husband’s medical records and consulting with another attorney I have decided it would be in the best interest for everyone for us not to proceed with any attorney/client relationship in regards to this matter.
In no way are we indicating you may not have a case. Our firm does not do regular practice in this area, therefore all parties would be best suited with another attorney. According to Wis. Stat. Ann. §893.55(1) all medical malpractice actions for personal injury or death must be filed within three years of the date of injury. We urge you to consult with another attorney in regards to this matter without delay. All medical malpractice claims must be filed within three years of date of injury. Records indicate your husband discovered his injuries August 27 2013, therefore the last day to file in this case will be August 27 2016.

No fee will be charged for our services provided. A fee of $61.00 will need to be collected for the retrieval of your husband’s medical records, these fees will cover the cost the hospital charged us to receive copies of his records.

Again, you are receiving this letter to inform you we will not be representing you in regards to this matter and will not be taking any further actions on your behalf. Enclosed are your medical records, a charge for retrieving medical records, a copy of the statute
