4.1. Brief Synopsis:
Operator 1(OP1, AFSAS Person 1) was operating his 2003 Subaru B4 (V1, AFSAS Object 1) when he struck a wall resulting in 7 LWDS.
4.2. Sequences of Events:
OP1 was returning to his office after departing the flight line on a two lane divided road traveling approximately 37 KPH with a post speed limit of 40 KPH. While in route OP1 was smoking a cigarette (OBJ2, AFSAS Object 2) in his right hand and drinking a beverage while holding the steering wheel with his left. A gust of wind knocked OP1’s cigarette out his hand and onto the car floor. OP1 immediately attempted to retrieve the lite cigarette with his right hand, taking his eyes off the road. While still holding the beverage and steering wheel at the same time. As OP1

    In order to determine the role of DD’s violation of the statute in the car accident the three-part negligence per se test must be applied to determine if . The three elements of the negligence per se test: whether the statute protects a class of individuals of which the Plaintiff is a member, protects against harm of the sort that the Plaintiff suffered, is an appropriate standard for use in the case. Applying this statute to the case it can be determined that the statute was created to protect the class of individuals such as the hitchhiker, i.e. passengers in other vehicles while DD was driving on the road in a tractor trailer truck which he was not licensed to drive. The state statute 101 was not created to prevent the type of harm that was suffered by the Plaintiff, the hitchhiker’s injury was caused by FF’s rear-ending DD and not by DD driving a tractor trailer truck.     As in the case of Acosta v. Southern California Rapid Transit District 2 Cal.3d 19, 84 Cal. Rptr. 184 (1970), the plaintiff walked through a half-filled bus to find a seat as she did this, the light changed and the bus started behind another vehicle approximately 40 feet behind it. The driver knew that on the next block there contained a mid-block crosswalk for pedestrians and as he approached the crosswalk he noticed several young boys crossing so he placed his foot on the brake and let the bus coast for about 15 – 20 miles per hour. He abruptly placed the foot on the break when the car in front of him came to a sudden halt in order to avoid hitting the boys going through the crosswalk. In that sudden stop, the plaintiff and two other women were thrown forward in the bus and fell over the coin box and onto the floor placing plaintiff at the bottom. The court in this case favored the plaintiff due to the issue that the bus being a common carrier needed to have the utmost duty of care towards its passenger’s and the court had acknowledged that with the evidence given the driver of the bus had not used the utmost duty of care towards his passenger’s since the driver had knowledge of his daily route and he should have taken more precautions when he saw plaintiff standing, knowing very well the traffic was not a steady flow. As in the case of Acosta, you, the bus company, are held responsible for carrying for your passenger’s.     Summarize: In December 1997, Dr. Abid Hanson and his wife, Rubina Husain (hereinafter respondent), traveled with their children and another family from San Francisco to Athens and Cairo for a family vacation. During a stopover in New York, Dr. Hanson learned for the first time that petitioner allowed its passengers to smoke on international flights. Because Dr. Hanson had suffered from asthma and was sensitive to secondhand smoke, respondent requested and obtained seats away from the smoking section. After boarding, they discovered that their seats were only three rows in front of the smoking section. A flight attendant refused respondent's three requests to move Dr. Hanson. As the smoking noticeably increased, Dr. Hanson walked toward the front of the plane to get fresher air. He then received medical assistance but died. Each year, more than 80% of drivers cite distraction as a serious problem and a behavior that makes them feel less safe on the road. Nearly half of all people who say they feel less safe than they did five years ago also say distracted driving by other drivers fuels their concerns. There are an abundance of accidents that come about when the sun is not up and people look at their phone then towards the road and still seeing the light of the phone.
