When I was a young nurse it seemed like problems I saw were continually put on a back burner or not treated fairly. It’s important to be accountable for mistakes. I have worked on a surgical floor for 16 years. On occasion we will be pulled to another unit if they are really short. I was pulled to an oncology floor when I had been an RN for about 3 years. I was not familiar with the chemo drugs and their schedules. But my med sheet had times listed when to hang certain things so I didn’t ask the charge nurse but went about hanging my drugs. Later in the day the oncologist saw what happened and threw a huge fit. I wasn’t told specifically what I’d done wrong but just that I was incompetant and he didn’t want me ever taking care of his patients again. That was hard to hear because most of the time I was told I was great to be around and a great asset to my unit. I asked the charge nurse what I done wrong. She said certain things weren’t compatible and that I had put the patient at risk but she also told me not to worry, she wouldn’t “report” me. She just kept poo pooing me and told me she would take care of things. It literally seemed like everything was just swept under a rug. Later after my shift was over I went back down to my floor and talked with my clinical educator about what happened. She used to work oncology so I knew she would understand that units procedures. The biggest obstacle for nurse practitioners appears to be physicians. According to the report, the majority of physicians feel that replacing physicians or filling voids where there are not enough physicians with nurse practitioners will decrease the quality of care that patients receive. Another obstacle for Nurse practitioner is getting reimbursement from insurance companies. Nurse practitioners receive approximately 80 percent reimbursement when compared to a physician, and some insurance companies do not recognize nurse practitioners, so they have to have a physician to work with them. These NP’s receive an hourly wage rather than a direct payment from insurance providers. The IOM report will change my practice by allowing me to feel as if I have a little more power in helping guide my patients care; it also empowers nurses to make more suggestions concerning care to physicians and will hopefully make physicians value the advice of the Nurses and help them realize what valuable resource nurses are. As the population grows, physicians will not be able to perform at a competent level and provide complete patient care without a substantial number of nurses. Reliance on nurses is necessary to reform the health care system. Barriers such as regultatory restrictions regarding scope of practice, professional resistance by physicians, and insurance company reimbursment pactices hinder RN’s and Advanced Practice Nurse’s from practicing to the full extent of their education and compromise patient outcomes (Richard Ridge, 2011). Autonomy is an issue in some states regarding APN’s role. Some states require physician oversight to diagnose, treat, prescribe, or make referrals. Compensation for services is also an concern. Independent insurance providers, Medicaid, and Medicare compensate APN’s at reduced rates or not at all and may not cover prescribed prescriptions unless a physician signs off. Professional resistance is also an problem. The Scope of Practice Partnership lobbies against state expansion of the APN’s role stating they lack medical education, clinical knowledge and cognitive and technical skills which are acquired only in medical school ( IOM, 2011). Acting lawfully as a nurse within their roles and responsibilities will reduce the risk of negligence. Negligence is the failure to present the level of care considered reasonable under the incident, consequential in an unintentional injury to an alternative party. Patients and associates have the right to seek out civil remedy for a lawfully recognised wrong. The tort of negligence arises from the common law and is a means by which a person who suffers damage through a negligent act or omission be capable of obtaining compensation from the nurse accountable for that wrong. As a result, when working within the nursing profession it is important for nurses to work within the scope of civil law. The scope of civil law relates to “patient safety; negligent advice; patient consent; patient freedom of movement; and patients’ property.”- (Daly, Speedy, Jackson, 2010, page 158). Advanced practice nurses are reimbursed at a lower rate, for the same services, than physicians. Medicare reimburses nurse practitioners at 85%, certified nurse midwives at 65 %, and physician assistants at 85% or less of the physician fee. I interviewed Joe Neal, Deputy Probation Officer III, Mendocino County Adult Probation. I learned a lot about the Probation Officer’s job and Joe during my time interviewing him. Joe started his law enforcement career at a young age. He did not go into much detail about his career start, but did tell me that he eventually ended up being a Juvenile Court Judge.
