The right to life is even given by the Constitution which includes that every individual has right to live his life peacefully. Australia had abolished death penalty under federal laws but thereafter Crimes Legislation Amendment (Torture, Prohibition of Death Penalty) Abolition Act 2010 had totally blocked the attempt in the matter of reintroduction of capital punishment in any region or part of the country. This meant that Australia had succeeded in totally abolishing death penalty.

The other problem will be of all the 12 members of jury cannot support such legal killings resulting in hung jury, and this may go on till all the 12 members of jury unanimously agree to same judgment. This will lead to expensive judicial procedures and system so public will have to pay more taxes.
Abolition of Capital Punishment has prevented Australian Government from discrimination, but if introduced in Australia, it is not possible to be carried on or administered without discrimination, bias and prejudice.
By inflicting or imposing capital punishment, the Government spreads a feeling of hatred against the person, a civilized nation or country should not allow this feeling of hatred to spread. The Capital Punishment is termed as a system filled with corruption and political games .Australia has abolished death penalty but the issue of capital punishment was not dealt with fully. It is stated by certain people who are not in favor of abolishing death penalty that what if a person brutally kills hundreds of people in a fit of anger or revenge or political interference for egg terrorists, than how can he escape death penalty. He should be punished for killing many people. A tit for tat principle should be applied but to say in favor of abolition, it is suggested by many human rights group that can they not be kept in personal prison where they are allowed to live there life freely and from where they cannot escape. Government can take extra precautions in this matter and provide for higher security cells for such horrendous prisoners Government should conduct rehabilitation programmers in the prison to live their life in a way that no degradation or inhumane treatment is inflicted upon them.
This excuse of killing the offenders due to the possibility of their escaping from prison is the ultimate one. It is the responsibility of the Government to protect its citizens from such offenders and in that case capital punishment cannot be inflicted upon persons escaping the prison. On one hand government makes various schemes for protection of human rights and on the other hand takes away a person’s life by giving legal sanction to death penalty. It is a civilized way of legally discriminating the offenders as Government does not kill all the killers, they are arbitrarily selected.
Conclusion
It can be thus concluded that the death penalty was considered as contravention of the fundamental rights of an individual and therefore it was abolished. The abolition of killing criminals was introduced keeping in mind the moral concern of the society. No country that is civilized can ever allow such laws that amount to human torture even in case of support by majority. It is false that people executed are worst offenders as even people committing murder, adultery and other non violent crimes are executed. So in true sense Capital punishment must be abolished in order to arrive at unbiased judgment. It is also seen that major criminals especially in drug trafficking are never punished as the factor of partiality and prejudice is played upon by the legislators and Government and other influential people.
Thus as suggested in favor of abolition of Capital Punishment , It should be the responsibility of the Government to take such steps in respect of the violent crimes by understanding all the relevant factors such as economic, sociological and psychological whereby the creation of criminals takes place. In case of any individual whether one is in favor of capital punishment or against it, the fact that it is a cruel, inhumane, uncivilized and degrading form of punishment cannot be disputed by anybody. It is a legalized procedure, coldblooded and the planning of killing a human being by the persons selected by Government. It is advised that the abolition of capital punishment is in the interest of the general publish, offenders and the society at large... so this has to be abolished by taking right measures considering the fundamental rights to life of the citizens. Human rights groups and organizations strongly believe that a public opinion should be raised while making the criminal policies or laws, when human beings in the sense the whole public at large are concerned.
