“Do School Drug Tests Violate Students’ Rights?”
To many students and their parents, taking a drug test is a violation of privacy. For the students it is ridiculous and embarrassing to pee in a cup for the school to test. Doing so without even telling the student first or asking if they are doing drugs. Some students refer to the U.S. constitution to show that random drug testing is a major violation of privacy. School drug testing should not be allowed because it is not necessary to invade in someone else’s personal life without any evidence.
“More drug tests in schools urged by White House”
Random drug testing on high school students has been urged by the Bush administration. By going as far as to pay $8 million for drug testing programs, rather than educating the students instead. There have been some parents, educators, and school officials, which believe this will not help and is an invasion of privacy and trust. Studies show that several schools in Indiana had more than …show more content…
half decreased drug use. Yet another study in 2003 said, 76,000 students did nit find the difference. So what happened next is a few school districts have adopted voluntary testing programs. Vernonia School District v.
Acton
The school procedure for urine drug testing is the student is in a closed stall and the female monitor could hear them. If the test is positive the first time the student has to take it again. If the second time around is negative the student can participate in sports. If it was negative instead, then the school would call a meeting with the students’ parents. There is a consent form that is to be signed by the student and parents, allowing the school to randomly drug test the student.
The Acton family refused to sign the form because they felt that it went against their sons constitutional rights. The school informs them that by not signing the consent form their son can not participate in any school sports. What next? The Acton’s file a lawsuit with the help of ACLU(American Civil Liberties Union) against the Vernonia School
District.
