Intellectual Property Rights: Copyright and Patent

Copyrights and patents hold a major importance for business owners, and companies. I will discuss in detail what a copyright and patent are and the importance the two of them hold.

What is Intellectual Property Rights; it refers to creations of the mind: inventions, literary and artistic works, and symbols, names, images, and designs used in commerce which leads to patents. What is a patent? A patent is an exclusive right granted for an invention, which is a product or a process that provides, in general, a new way of doing something, or offers a new technical solution to a problem. In order to be patentable, the invention must fulfill certain conditions which are it must be new, inventive, and industrial applicable. Novelty meaning the invention must not e known before you file your application. It does not matter how, by whom or when in the world it has been made known. The invention counts as known even if it is you yourself who has used or published it. Inventive step is meant that the invention must differ significantly from what is already known. The solution must not be obvious to a person skilled in that technical area. That means new ways of combining known methods or objects are not necessarily patentable. Industrial applicability the invention must be industrially applicable. An invention is considered industrially applicable if it can be produced or utilized in any kind of industry but also other activities, such as transport, agriculture, hunting, public services and medical services. The type of protection a patent provides is that the invention cannot be commercially made, used, distributed, or sold without the patient owners consent. These patent rights are

A patent can be viewed as an agreement between an inventor and the US government. The government grants the inventor a temporary monopoly, exclusive rights to make, use, and sell the invention, in exchange for making the invention public. Patents protect functional features, such as a special kind of disposal used in Kenmore dish washers. The patent law provides that the patentee’s exclusive rights exist until the expiration of…

This chapter opens another realm of complexity that I would be of great value to me as an engineer. Coupled with starting a new business idea is a set of rules and regulations which an entrepreneur must be weary of. Some innovation can be patented due to its uniqueness and as an incentive for encouraging more innovation. A long and sometimes tedious process is detail by Dr. Kuratko. Part of the process is keeping evidence of how you came up with an idea, in black and white. I have learned the importance of doing so in my engineering classes and through internships. Patent, Copyright and Trademark law are set to protect the original inventor from people who want derail you venture with counterfeits. Also in this chapter Dr. Kuratko defines the types of business ownership model an entrepreneur can be interested in, with corporations being the largest and most confusing to me. He also states how companies my face doom as bankruptcy and liquidation. This can be exemplified by Trump who filed for bankruptcy several times.…

Delroy, I liked how you mentioned that a patent doesn’t just give an inventor the right to make and sell their invention for a set period of time, but it also protects a product or deign established by an inventor. I agree with you that it makes the product better for the customers to recognize and makes the products more obvious. I agree and like your examples of violations of patent and copyright, that someone can’t sell his or her invention without permission and that a violation of copyright is if someone makes copies of a book and printed them to use it for their own benefit or to make a profit off of it.…

Intellectual property rights refer to a design or creation that any individual has created and documented down in a way such as music, inventions or lyrics. As the owner of the work you have created you naturally inherit certain rights dependant on the nature of the work you have thought of. I think this is a fair and rewarding process to the inventor. It also gives an incentive for others to put there ideas forward to gain a money to cover the purchasing of any research or resources they would have had to buy. More detail of this can be found available at…

According to Devine (2011), Intellectual Property are of four kinds -- copyrights, patents, trade secrets, and trademarks. The same source mentioned that copyright is a form in intellectual property that protects the original authors of both published and unpublished creations. Copyrights have to do with someone writing or making something and have the rights to the article to call it theres. Patents are kind of the same thing the only difference is you came up with the idea and are now trying to sell the idea, trade secrets are you working for a company and having to hold yourself to the to not telling anything. Trademark is like what is on certain things such as the Christian Loubotin shoes he has a trademark that no other designer can have on there shoes they can come close but they can not have is trademark that is how everyone can identify what his shoes look like. First, the innovators should avoid publishing the innovations in an environment where new technology is difficult to protect. Second, the more fundamental the innovation, a broader patent will be granted, which will provide better protection. Third, design the innovation to have a good chance of benefiting innovators rather than their competitors. Forth, try to make the innovation to be accepted as the industry standard. Fifth, monitor their competitors, especially those own important complementary assets.…
