The Labor Laws of Human Resource Management
There are many labor laws in Human Resource Management. Some of the labor laws are Americans with Disabilities Act, Fair Labor Standards Act, Title VII, Immigration Reform and Control Act, Family Medical Leave Act, and Age Discrimination in Employment Act. I was unaware of how important these labor laws are to an organization to follow. These labor laws can truly make or break a business. I found researching each law to be very beneficial and informative. The Americans with Disability Act is so very crucial for a business to follow so that there is no discrimination against those with disabilities. It is important that a business always makes accommodations for the disabled no matter the disability. To be a qualified individual the individual must be qualified for a job and perform essential functions on the job. The individual with disability must turn in a record of employment into the employer. Drug addicts are considered disabled because of their addictions. Drug addicts are covered as long as they are seeking treatment and are no longer using the drugs. These same procedures also apply for alcoholics as well. The Fair Labor Standards Act establishes minimum wage, overtime pay, record keeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments ("Handy reference guide," 2010). In order to meet Fair Labor Standards Act requirements, employers must keep accurate time records and maintain those records for three years (Mathis & Jackson, 2011). The Fair Labor Standards Act focuses on three major areas: establish a minimum wage, discourage oppressive use of child labor, and encourage limits on the number of hours employees work per week, through overtime provisions (exempt and nonexempt statuses).
