Constitution and Texas Constitution. Both constitutions work together to provide all citizens with a free and public education. The U.S Constitution is the Supreme law of land and the Texas Constitution provides the specifics laws in which education must abide by in order to receive the funding necessary. Although, the school board decides some rules, all rules ensure that all students are receiving a free public education. All students includes students with disabilities, transgender students, and students of a different race. Special Education students should also be provided with a free and public education and the opportunity to learn in the least restricted environment. Special education students are protected under the Individuals with Disabilities Education Act (IDEA) (20 U.S.C. §§ 1400). Also, students of different gender, race, or religious preference are protected by the 1st and 14th Amendment in the constitution. In current event many issues have aroused on the used of specific restrooms and if these students have the right to use the restroom they feel identified by. Many people seem to disagree with the state government for not allowing students to chose which restroom to use. According to the Title IX of the Education Amendment of 1972, the federal law prohibits discrimination of federally funded education program based on the sex of the person (20 U.S.C. § 1681). Many argue that their constitutional rights are being violated and that they feel discriminated by the government. This current event remains unresolved but it will be the federal and state government to ensure that every student has the right of an equal
