The Legend of Sleepy Hollow written by Ivring was a very interesting story that is well known around the world today. The movie was far more entertaining than reading the book If I must say so myself. Tim Burton gave a new spin to The Legend of Sleepy Hollow. I myself have always enjoyed anything written or directed by Tim Burton because of his sense of horror and his creative abilities. The characters are redefined even though Tim Burton strays away from the book and put his own ideas into what should happen in Sleepy Hollow, because of this the story is altertered and more lifelike and connectable. Bron who was very important in the book is even hardly recognized in the movie even though he was willing to give his life for his love Katrina. Bron who actually did give his life for Katrina in the story is horribly overlooked in the movie.…
With a great deal of debate the design of the United States along with the lay out by the founders of the country who took their roll in laying down the “rules” of the United States of America very seriously. The Articles of Confederation, the Bill of Rights, and the US Constitution lay the floor work of a layer of protection afforded to all United States Citizens. Each of the doctrines provides a step towards the written words that have granted many men and women protection from persecution as well as freedoms not received in other parts of the world. The last piece of the three historical documents, the US Constitution is comprised of a set of amendments, which have been written to protect several different rights that as a citizen are protected from false persecution. These constitutional amendments play a large roll, in the manner in which aspects of court procedure handled in both juvenile and adult court systems.…
13. A Felony or a Misdemeanor is any crime that is punishable by death or imprisonment for more than one year?…
In the Rights of Man, Thomas Paine portrays America as an ideal nation during the late 1700s. His characterization of the American government is correct in the sense that democracy in America does give citizens their basic rights and the ability to protect them. However, Paine’s view of a democracy is flawed. On many occasions, the government has failed to protect these basic human rights, thus disproving that it is entirely “just.” As America is becoming more culturally diverse, society is becoming less concordant.…
“When someone commits a felony, it is a matter of free will. No one is compelled to commit armed robbery, murder, or rape. The average citizen does not have the mind or intentions to become a killer(Ornellas).” This statement by Lori Ornellas, a victim in the brutal murder of her nephew shows us that when someone commits a crime they do it on their own account. In the United States today more than six thousand murder investigations a year go cold or go unsolved(Rein). This means that there are so many murders that get away and are not held accountable for the crimes that they have committed. Today in our society capital punishment is a form of punishment that is implemented in our justice system. Capital punishment should stay implemented in our justice system because, the death penalty can serve as a deterrent for violent crimes, the death penalty is morally permissible in today’s society, and under our Constitution the death penalty legally permissible.…
1). The other 19 states have completely abolished the death penalty. Most states who authorize the death penalty punish the crimes of murder or other capital offenses. Few states today authorize the death penalty for individuals who have committed the crime of sexual assault or rape. In these cases, there is a criteria differing from state to state to determine whether it should be applied or not (“Crimes Punishable by Death,” n.d., para. 1).…
There are various forms of sentencing that are used in the criminal justice system and each has its’ own rationale. These include but are not limited to the death penalty, incarceration, suspended sentence, probation, and restitution. The death penalty must be requested by the prosecutor and in some rare cases the defense. The death penalty can also be recommended by a jury, however only specific crimes are eligible for the death penalty. Most states require a certain number of witnesses in order to qualify the defendant for the death penalty. These crimes vary from state to state and include aggravated rape of a victim under 14 (including repeat offenses), espionage, piracy, ransom kidnapping, treason, and most commonly aggravated first degree murder. Incarceration is another popular form of sentencing. Although jail and prison are often used interchangeably, they differ. A prison sentence is typically longer and for those who commit felonies. A jail sentence is shorter and for those who commit misdemeanors, who are awaiting trial, or waiting to be transferred to a state facility. The ideology behind prisons is easy to recognize. We follow prisons in every…
There are 2 classifications of crimes that criminals in the United States can be charge with either a misdemeanor or a felony. Depending on what state someone commits a crime determines what classification of crime they are charged with. Many states take the crime and the max incarceration period into consideration when determining what to classify ones crime as. If one is charged with a misdemeanor they normally will not be incarcerated for longer than a year. Examples of misdemeanors are theft under a certain dollar amount, vandalism, public intoxication, and or reckless driving. The financial burden of a misdemeanor compared to a felony is lower as well. If charged with a felony they will normally stay long after a year. Examples of felonies could be money laundering, murder, or manslaughter. Under the classification of a felony some jurisdictions also classify felonies into degrees or grades of seriousness for example class 1-6 felony and aggravated felony.…
‘We the People’ are the driver; the government is the car. And we decide where it should go, and by what route, and how fast. Almost all the world's constitutions are documents in which governments tell the people what their privileges are. Our Constitution is a document in which ‘We the People’ tell the government what it is allowed to do. ‘We the People’ are free.” I agree with what Ronald Reagan said in his Farewell Address, we are the ones who give the Constitution power and meaning. The Constitution is for “the people” and as we grow and mature as a nation these simple words “we the people” will continue to grow along with…
Throughout the years, the death penalty has continued to be an ongoing controversial issue in the United States. While there are many supporters of the death penalty, there is also a great amount of objection. This type of punishment has been around since the eighteenth century in order to assist in a form of a consequence. It continues to be used to discipline those who break the laws and standards that are expected of them, by sentencing them to death. Ever since, it has become the highest level of punishment that can be handed down to someone in the criminal justice system; however, it has also raised many concerns. The process of getting off death…
We the People of the United States” is the famous line that begins the Constitution of the United States. Since the signing of the constitution it has been realized that “We the People” does not necessarily refer to everyone. In actuality, “We the People” really refers to the white male. This is apparent just by looking at some of the amendments to the constitution. For if, “We the people” was intended to cover every person than we would not have amendments that abolished slavery and we would not have amendments that granted women or blacks the right to vote. From the beginning of our countries start, equality in American was set up to mean equality between white men and white men only. Women have suffered and worked hard to make progress to…
Punishment in the United States is always evolving, always changing to meet the different demands of our society. A unique aspect of our society is that we, as members of society, deem what is socially acceptable and what the punishment should be for those who violate our rules. In this paper, we will be discussing the different objectives of punishment at the state and federal level. We will also explain how sentencing affects the state and federal corrections systems overall. Lastly, we will define determinate sentencing, indeterminate sentencing and which sentencing model…
Convicted felons can be punished in many different ways, but one thing is sure it would not be cruel and unusual. Before we look at how we punish offenders we must first understand why we are punishing them. The general purpose behind punishment is to inflict upon criminals some kind of suffering for the crime that they have committed or to protect society from those considered too dangerous to live amongst us. Punishment, a necessary evil, is sometimes required to deter law violators from repeating their crime and to serve as an example to others who would also violate the law. Schmalleger, Frank J. Criminal Justice Today An Introductory Text for the 21st Century (81).…
The death penalty has been a criminal sentence imposed in America for hundreds of years, but it have been extremely controversial as Evan Mandery illustrates in “A Wild Justice: The Death and Resurrection of Capital Punishment in America.” Today, the death sentence is strictly used in murder cases and in thirty-two out of the fifty states in America. In these states, it is completely legal to use the ultimate punishment of death to incapacitate a criminal from committing any further harm to society. Throughout American history, many individuals have supported the death penalty because they believe it is an effective way to deter crime and is a form of retribution. Others have strongly advocated against capital punishment because it is not morally correct and it not applied fairly. Also, some argue that it is unconstitutional to use the death penalty because it violates the cruel and unusual punishment provision of the Eight Amendment written in the United States Constitution.…
While there are some variations among state sentencing guidelines, most establish punishment by the severity, frequency, and nature of the crime committed. For example, in Michigan, if an offender is arrested for burglary and has a previous drug arrest, state sentencing guideline ratings provide a range of sentencing options from alternative community corrections to up to a 24 month prison sentence. The community correction option allows the judge to sentence the offender to a secured community-based substance abuse treatment program for six months, followed by a short probation period. The judge has the discretion to choose from an array of options. On the other hand, if an offender is convicted of a serious felony and has previous non-violent felony convictions, sentencing guidelines provide that alternative community corrections is not an option, and require a minimum 24 month prison…
