What Are The General Obligations That Paralegals Have When They Operate Their Own Practice
Rule 8.01 discusses the general obligations that paralegals have when they operate their own practice. Paralegals who choose to start a practice have a financial obligation to their client, unless the paralegal states in writing that, “it is not to be a personal obligation of the paralegal” (Paralegal Rules of Professional Conduct, 2018). Pursuant to rule 8.01(3), a paralegal has to supervise staff and assistants when they are delegated tasks within the firm. A paralegal is not allowed to delegate to their staff to provide legal services, to be held out as a licensee, to perform any duties that a paralegal may perform or do things that paralegals themselves may not do. It is essential that the paralegal the delegates a task to their assistant …show more content…
A paralegal shall not promote themselves in a false or misleading way, amount to coercion, duress or harassment, take advantage of a person who is vulnerable, influence a person who has already retained legal services, bring the paralegal profession or the administration of justice into disrepute (Paralegal Rules of Profession Conduct, 2018). A good example of what not to do would be posting an advertisement in a bathroom stall above a toilet or posting a radio ad that involves very aggressive language. When a paralegal advertises their services in these ways, it can tarnish the reputation of the legal profession. The legal profession is one that has always been very conservative. Advertising your services in a non-conservative way may raise issues with the Law Society of Ontario if they were to find out. It is important to follow rule 8.02 when advertising and communicating with prospect clients. Ensuring that a paralegal follows the Paralegal Rules of Profession Conduct helps protect the public from harmful legal services and keeps the administration of justice in good standing with the …show more content…
A paralegal may only market legal services that are demonstrably true, accurate, and verifiable legal services, is either misleading, deceptive or confusing, and is in the best interest of the public with a high standard of professionalism. A paralegal can advertise legal fees if the advertising is reasonably priced, the advertising includes other amounts like disbursements and HST, and the paralegal strictly follows the advised fee in every case (Paralegal Rules of Profession Conduct, 2018). The Law Society of Ontario prohibits lawyers and paralegals from advertising their “best case”. When bringing up a successful outcome, the lawyer or paralegal need to make sure they are advertising that this was a one time occurrence and that an outcome like such is not the case every time. Moreover, not advertising exact prices helps ensure you are not “fooling” or “misguiding” future clients. When advertising legal services, a paralegal must show that they are a licensed paralegal and not a lawyer. It is illegal to advertise yourself as a lawyer to potential clients. Clients may refer to you as their counsel; however, if this occurs, politely remind them that you are an agent before the court and are not their legal counsel. A paralegal may run into this problem at court as well, remind the Judge, Justice of the Peace, or Deputy Judge that you are an agent before the court and not counsel. Having an open dialogue

In every state it is illegal for a paralegal to practice law, they are not attorneys. If Polly Paralegal contacts them and gives them legal advice she would be engaging in UPL because she would be acting as an attorney but she is not an attorney. The best thing for her to do is tell them she cannot give them legal advice because she is not an attorney but she can get the information and give it to her supervising attorney so he or she can help Mr. and Mrs. Smith with their divorce situation. In order to find out if Polly Paralegal would be engaging in UPL if she answers Mr. and Mrs. Smith you have to know what UPL is and the rules. UPL is short for unauthorized practice of law. UPL is basically when an attorney practices law where they are not licensed to and paralegals are not allowed to give legal advice. Attorneys can only practice law in the states where they are licensed. Paralegals…

Attorneys expect a lot from their paralegals, and the same can be said for the paralegals as well. A good attorney should be able to recognize the brains he/she has working for him/her as paralegals and reward them with more challenging work. By providing paralegals with interesting work, involvement with clients and cases, and good supervision, more firms and corporations have a greater chance of keeping those individuals working for them and even possibly have them further their education, such as possibly going to law…

Sofia, I completely agree. That a paralegal’s average pay is reasonable based on the level of education needed to become one. I was quite intrigued to find out that paralegals in San Francisco make $70,000 annually. It seems like a lot of people believe paralegals should earn a higher salary. Because of the amount of work they do on a daily basis. I think that if we are truly passionate about the learning the law we won’t work a day if we obtain a position as a paralegal. Working under the supervision of an attorney will prepare anyone of us interested in going to law…

Just giving advice to a client is ultimately Unauthorized Practice of Law because a simple conversation can involve an effect on one’s legal rights. An example of potential UPL mentioned in the book is telling a client where to sign a legal document. As simple of a question as it seems, this has a lot of responsibility pertaining to the lawyer and not the paralegal. The main reason why is because the legal rights of a client may be affected since the client may have to indicate representative capacity (Goldman and Cheeseman 44)…

They should always refrain from advising a client on any legal issue, because again, this is not in their job description. Typical duties of a paralegal may include, retaining an affidavit from a client, interviewing a client, organizing files and drafting certain legal documents. A typical day for a paralegal, either in a small, or large firm, may include these said duties, as-well-as secretary work, answering phones, and scheduling an initial interview. A paralegal should take strict direction from any ethics course given, as well as direction from their supervising attorney. “It is essential that paralegals understand and follow attorneys’ professional rules, because, as agents of attorneys, paralegals are bound by those rules and can subject the attorney to liability for their violation.” (Anne Lang, Administrative Law, Monroe Community College, 2012)…
