SUBJECT: Complaint Procedures 17 September 2010

POLICY # ORIGINATING SECTION ORIGINATOR PHONE
1-4-11 S-1/EO CPT Burns 798-6237

APPROVED BY:

MICHAEL A. BALL, LTC SF, Commanding

SYNOPSIS

1. PURPOSE: To provide command guidance on complaint procedures.

2. SCOPE: This policy applies to all service members assigned/attached to the 4th Battalion, 5th Special Forces Group (Airborne).

3. GENERAL:

a. The EO complaints processing system addresses complaints that allege unlawful discrimination or unfair treatment on the basis of race, color, religion, gender, and national origin. Attempts should always be made to solve the problem at the lowest possible level within an organization. Complaints by civilian personnel alleging discrimination should be handled in accordance with the procedures contained in AR 690-600, or as described in DoD and Department of the Army policy implementing 10 U.S. Code 1561, or as provided for in any applicable collective bargaining agreement.

b. It is each commander’s responsibility to make it known that Department of the Army policy prohibits discriminatory practices and sexual harassment both on and off-post and to give assistance to service members, their family members, and civilian employees who are faced with these issues.

c. Individuals have the right to:

(1) Present complaints without fear of intimidation, reprisal, harassment or retribution.

(2) Communicate with their commander concerning their complaint.

(3) Receive assistance when submitting either a formal (sworn statement) or informal complaint.

d. Individuals have the responsibility to:

(1) Attempt to resolve the complaint by first informing the alleged offender that the behavior must stop. Depending on the situation or severity of the offense, this may not always be appropriate.
