Grade Details | | | | 1. | Question: | Teddy's Supplies' CEO has asked you to advise him on the facts of the case and your opinion of their potential liability. He wants to settle the case. Write a memo to him that states your view of whether the company is exposed to liability on all issues you feel are in play. Include in your memo any laws that apply and any precedent cases either for or against Teddy's case that impact liability. Include in the memo your suggested "offer of settlement" to Virginia. Back up your offer using your analysis of the case against Teddy's. | | Your Answer: | Dear Mr. Moore, After reviewing this case, I can state that Teddy’s Supplies is definitely liable for the workplace and sexual harassment against Virginia Pollard. According to the facts, it’s indicated that Ms. Pollard (plaintiff) was placed in a ‘hostile’ environment and Mr. Steve King was her supervisor. Although it is not illegal for 1 woman to work with a group of men, it should be carefully determined by the employer if the environment is suitable for males and females to work together. In this case, it was not a good idea for 1 woman to work with male associates. • Workplace environment can by justified by 7 ways: race, gender, national origin, religious, color, age and disability. In this case, Pollard was constantly being harassed by her male colleagues. They played pranks on her by locking her drawers shut, filling the guard shack with trash, locking her out of the guard shack and therefore she was not able to perform her job duty since she was responsible for watching warehouse inventory. Also, Ms. Pollard was put into unnecessary risk of harm when a coworker backed a forklift up to the guard shack and it backfire into her ear. Ms. Pollard could have sustained injuries if the forklift had hit her because it weighted 3 tons and it could have easily injured her eardrums because it is very loud.

The tax issue here is that John Smith wants to know how the $300,000 he earned through his client fee is taxed. The $300,000 is taxed as ordinary income and is taxed in the year received. John Smith worked on the case for two years but he did not earn the $300,000 until this year so he will include it in this year’s taxable income. Therefore John Smith needs to include the entire $300,000 as ordinary income on his Federal tax return. Gross Income means all income from whatever source derived which includes compensation for services, including fees, commissions, fringe benefits, and similar items. (IRC Sec. 61(a),(1))…

I chose to read the speech made by Elie Weisel about indifference around the world today and in the past. This speech was very touching in my opinion and I believed showed examples of Bias, Rhetorical devices, and argumentation. Elie Weisel was able to connect with his listener by sharing his heartbreaking and emotional experience. He then talked about other instances where injustice occurred around the world. Elie Weisel made good arguments as to why we we do and why we cannot ignore these injustices. We must stand up and fight against those who oppress. It is so easy to ignore something happening right next to you when it does not affect you. Live and let live, don't ask don't tell, what I cant see cant hurt me...All of these things we say to ourselves to feel better about not standing up against evil. Feel better about being selfish human beings. In this essay I will discuss the different Arguments made, how these arguments and counter arguments were addressed and how effective Elie Weisel’s speech was.…

Australia’s involvement in the First World War began in the 1914, its actions representative of its support of Britain’s declaration of war. This unity is implied by the amount of men who felt duty bound to serve Britain’s interest, corresponding to 40% of men enlisted who are aged between 18 and 44. Of these amounts, 330000 men went abroad, whilst 60000 passed away and another 150000 returning with injuries (Dyster & Meredith 2012, p.96). Hence, the absence of these men during the period of Wold War One itself signifies major impacts to the Australian economy, coming in the form of a decrease in labour supply, thus triggering changes in the economy to attempt to replace these shortage. This dilemma is further compounded with the difficulties Australia experienced in its trade agreements during the war and its attempt to resolve it through import substitution, which however, triggers both positive and negative changes, hence altering the structure of the economy. Furthermore, the return of the soldiers from war, and Australia’s attempts to reabsorb them to the community also causes difficulties for Australia, which are compounded by the lack of finances involved to act upon this plan, hence straining Australia’s debt.…

Hester Prynne, from The Scarlet Letter by Nathaniel Hawthorne, was alienated from her society for committing adultery with Reverend Dimmesdale. The bible says the man who commits adultery will suffer, and he will be in despair. Job 15:20, 21, 22, 23, 24 and 25 says “All his days the wicked man suffers torment, ... Terrifying sounds fill his ear; ...He despairs of escaping the darkness;...Distress and anguish fill him with terror; they overwhelm him, ...because he shakes his fist at God...” Reverend Dimmesdale struggled with God throughout the whole novel, and God causes him suffering and pain.…

Sacrifice. Sacrifice is when something is given up or lost for someone or something. A sacrifice is something that is difficult to make and possibly uncomfortable to perform. According to Bernadette Devlin, “to gain that which is worth having, it may be necessary to lose everything else.” (thinkexist.com). I showed an example of sacrifice when I was in 6th grade. My two best friends, Shannon and Tori, had accidently planned their birthday parties on the same day, April 24th. I had been invited to both, and I could not decide on whose party to go to. Eventually, I made the right decision not to attend either of their parties and went on a family trip instead. Ultimately, I made a good choice because it didn’t harm others, I put others before myself, and I thought about how it would affect the future.…

Racial profiling can never seem to make its way out of my life. It is a form of discrimination where someone is judged due to their race. Whether I am at school, marching band rehearsal, a restaurant, or even a doctor’s office, someone feels the need to judge me based on the color of my skin. I have never thought this was “okay” or “acceptable” in society. Throughout the seventeen years of my life, I recall having about three friends that have never made a comment about my race. People who judge someone based on the way they look and what their background is are some of the lowest of human beings. Most of the people who are affected by this issue tend to be minorities; however, any person can be a victim of racial profiling. Some people might think that racial profiling does not exist; nonetheless, I would like to bring the situation into focus and prove that it does still exist.…
