BOYER v. IOWA HIGH SCHOOL ATHLETIC ASSN.
The case against Iowa High School Athletic Association was created by Marian Boyer. Marian Boyer attended a basketball game Roosevelt Junior High School in Mason City, Iowa. Boyer, her husband and two other witnesses, Mr and Mrs Garland, sat together at the tow row bleachers. According to the case brief when the bleachers are not in use they are pushed back toward the wall. It takes three men to pull the bleachers out from their folded position and during the school year the bleachers are pulled out and pushed back two to four times a week.
During the game between Mason City and a nearby town, Marian Boyer, stated that the crown was very excited standing up on the bleachers and foot rest. She, her husband, and the Garlands did the same. The game ended, and it was time for Boyer and her group to leave. As they got up the seats and footrest collapsed and Mrs. Boyer and Mr. Garland were thrown onto the floor and Mr. Boyer was hanging by one foot on the bleachers head down. The trial court ruled there was no evidence to support her claims of negligence so the case was thrown out.
I can not say that I totally agree with the case. I do believe that this case shouldn 't have been thrown out and a thorough investigation of the bleachers should have been done. How many times has this happened? Do the school have monthly equipment checks, where they check and see what condition of their equipments including bleachers are in? What happened to Mrs. Boyer and her friends shouldn 't have happened if the school would have checked out the bleachers before the game started. The high school should at least pay for any injuries that were caused by their
bleachers.
