Is the U.S. Constitution a Democratic Document?
A democracy principle is built on “mob rule”, which means that the majority wins and the rest of the people lose. Unlike democracy, a republic principle guarantees that all the people receive the equal rights and benefits. The debate that if United State of America is constitutional republic or constitutional democracy has been going over years. It is true that the citizens in Unite State are receiving most of the individual rights, yet there are evidences showing that people are still living under lots of restrictions. Instead of that the citizens vote for their own president, people elect the representatives to vote the presidency for them. It would be more democratic if people were able to take care of legislative matters or decide their laws directly. Moreover, the Electoral College for electing a leader is not a democracy model as well. It weakens the purpose of democracy because citizens do not have the equal power on their votes. Since the electors for Electoral College are voted on state-by-state basis, people in the states with larger populations have less influence than people in the states with smaller populations. Therefore, when it comes to electing the president, citizens from small population states have a stronger voice than those who live in bigger states. In addition to the way of presidential election, the existence of states and their representation in Senate is not a democracy principle as well. One of the reasons is indirect election of presidency, which means that people are not allowed to vote for the president directly; Electoral College scheme, which it may be unfair due to different populations; representatives in Senate, which it could be an inequality among different states. Even though there are people arguing that America is representative democracy, it is a kind of republic government by its represented electors. Although a democracy is a government form that enables citizens to decide or design their own policies by voting or taking part in meetings, it should not be a conclusion that a good government should be democratic. It is possible that under democratic government, majority deprives people’s individual right. As long as the system can keep the peace and organize the entire process of society, it is an admirable government
