Flor Ortiz Professor Sherry Sharifian Gov 2305-73012 10 February 2018 Civil Rights Vs. 1 Civil Liberties Are civil rights and civil liberties the same thing? Many People believe it that way. There is a big difference between civil rights and civil liberties and you shouldn’t confuse them because that can change how you live your life. The differences between these two are that civil rights mean that you cannot be discriminated or treated differently and to get equal treatment. The government grants civil rights to protect their citizens and give them fairness. While civil liberties include your rights for example, freedom of speech, right to privacy, right to vote, right to liberty and much more. 2 Civil rights are rights guaranteed …show more content…
to all citizens without further explanation.
Civil Liberties focused on the Individual and they are provided by the bill of rights. They ensure that the government doesn’t interfere with our freedom and our rights. Civil Liberties include the 4th amendment that means that you cannot be searched of your property by the government without a reason. Another thing is that only because you have freedom of speech it doesn’t necessarily means that you can say whatever you want, it means that you have the right to speak but without hurting anyone or putting anyone in danger with what you say.
Civil Rights focuses on equal rights for everyone and equal protection under the law and equal opportunity in society. Civil rights are provided through laws and amendments. It’s mostly about the government helping individuals to ensure that they have certain rights.
3 Terry Stop also known as stop and frisk is when an officer has a suspicion of an individual who is armed, engaged, or about to be engaged in criminal conduct with that the officer has the right to stop that person and searched them to make sure they don’t have anything dangerous.
An example of the law not doing their job correctly is the case of Nafiys Walter who was stopped by two white officers for passing a red light. He said that he was in a bicycle and not a car but that’s not the problem here. The problem is that they searched Walters underwear just by passing a red light. The officers can only do that if the person looks suspicious, but another problem is that officers only stop Hispanics and Black people because of their race and that’s not how it’s supposed to …show more content…
be.
The supreme court has decided that in order for a police officer to inspect someone’s private areas and clothes is in a police or medical building after the person has been arrested but only if they suspect that the individual has a weapon or contraband and this can only be conducted by a licensed physician.
I think that GPS Surveillance vehicle without their knowledge can be possible in some cases depending if the police thinks that person is doing something bad but anyways that violates the rights of the other person that violates the 4th amendment. The same goes with police using drug-sniffing dogs in the front yard arounds someone house if they suspect something but only when they get permission to do it. For DUI checkpoints I think that a search warrant should only be done depending on the way you are driving not just because they decide to stop you for no reason. In profiling I believe that officers should keep an eye on people who already had serious criminal records including, use of weapons, violence and gangs but shouldn’t abuse on
that.
Looking at all this I can say that not everyone is taking the right actions on civil rights and civil liberties and they shouldn’t abuse on this because people have rights and they should deserve equality no matter their race, gender or how you look.
