DUI ASSIGNMENT
Vehicle Code 23153: 1) it is illegal for anyone under the influence of alcohol or the combined influence of alcohol and drugs to drive a vehicle. 2) It is illegal for a person that has over 0.04% or more, by weight, of alcohol in blood stream to drive a commercial vehicle.
According to Dui.com , drivers in California that get a first time offense dui will get the following as punishment: A) $1300 fine B) 3 years probation C) 3-5 day sheriff work D) First offender school E) 6 month license suspension
Dui enhancements: A) Prior dui conviction can receive a minimum of 48 hours or 10 days community service. B) Refusing to perform chemical test when being arrested for dui will cause you to lose driving privileges for a minimum of 6 months to 1 year. C) Excessive Alcohol blood content of .20 % or higher gives the court the right to choose the sentencing. D) driving over 30mph the speed limit highway or 20mph in residential will give the driver an additional 60 term in jail. If this their first offense they must attend alcohol /drug education and counseling program. E) If a driver is under 21 and has an alcohol content above .01% they will have their license suspended for 1 year. F) If driver is convicted of dui and has passengers that are under 14 years of age they can have a number of enhancements on sentencing including jail time up to 90 days.
Child endangerment in relation to DUI is when the driver that is intoxicated has passengers that are under 14 years of age. By doing that they are subject to having the following penalties:
