Emergency Driving Observation
On Sunday, April 9, 2017, I, Deputy Waldschmidt was driving southbound on US 81 near Wellington, Sumner County, Kansas. While driving, I observed a tan 1999 Ford Windstar (KS 644JVR/ VIN # 2FMZA5242XBB73220) approaching me. The vehicle was traveling northbound in the 600 block of North U.S. 81, at a greater speed than the posted speed limit of 65 MPH. I checked my front radar and observed the vehicle traveling at a speed of 75 MPH in a 65 MPH zone. As the vehicle continued past me, I checked my rear radar and observed the vehicle traveling at a speed of 75 MPH. I stopped, turned around and activated my emergency equipment. I stopped the vehicle in the 700 block of North U.S. 81.
I approached the driver side window and made contact with a white male who was identified as Javier Leon-Grado

I escorted Javier to the rear of the vehicle. Once there, I asked Javier if he knew he had a suspended driver’s license and he said no. At 1805 hours, I took Javier into custody by placing him in handcuffs, behind his back. I told Javier he was under arrest for driving while suspended before searching him search incident to arrest. No contraband was found. I escorted Javier to my patrol vehicle and placed him in the backseat.
I returned to the vehicle Javier was driving and made contact with the passenger Tracy A. Martin (DOB: 03-11-1972) who was identified by her Kansas driver’s license. The vehicle was released to Tracy who had a valid driver’s license and was the registered owner of the vehicle.
I transported Javier to the Sumner county Jail where he was booked for driving while suspended. Note: While in the pre-book room, I noticed Javier's system generated driver's license showed he had a middle name that started with an "L". When I asked Jaiver about it he said he had two last name. One was Leon and the other was Grado. When I asked Javier if his last name was hyphenated he said
