2. Main features of current employment legislation
The Health and Safety at Work Act requires a safe working environment for everyone in the work setting. There is usually a Health and Safety designated person whose responsibility it is to make sure the Health and Safety rules implemented. It is also the employer’s duty to make sure that there is an appointed Health and Safety person. If they themselves are not the appointment person as it usually is in the case with small business. Then it is their duty to make sure the health and welfare of their employees is properly cared for.
The National Wage Act ensures that all employees are entitled to a national minimum wage, which must be paid by employers. Regardless if they:
* Work at home rather than a the work premises
* Where you work in the UK
* Get paid monthly or weekly
* How big the company/employer is
* If you are a full /part time worker or shift pattern worker
* And how you get paid, cheque/cash etc.
The Human Rights Act is for a person who considers themselves a victim of violation to their human rights. This act gives the person the right to take court action or go to a tribunal.
The Employment and Equality Act is in place to stop unlawful discrimination against people e.g. disabled people. The Employment and Equality Act means an employer must make suitable arrangements for a disabled person to attend an interview or during work if they are hired. If the employer is discriminating then this Act is here to ensure action can be taken against the employer who may be brought to a tribunal and/or further court action can be taken.
