In Fasano’s case, Officer Byrd and Officer Troy both work at the local police department and were investigating the hackings on campus. On the day in question, the officers arrested Fasano while wearing civilian attire. The officers still identified themselves as officers working on the case, displayed their police identification, and explained the search warrant they had for the residence. As a result of following up with a credible tip into the investigation and having a warrant for the premises already, the probable cause needed from Henes is established. Therefore, the officers were working in their official capacity when Fasano stalled them during their investigation.…

The Fair Labor Standards Act (FLSA) affects most public and private employment. The act requires employers to pay employees, who are not otherwise exempt, at least the federal minimum wage and overtime pay for more than 40 hours worked in a given workweek. The FLSA was originally established in 1934, but has been amended several times in order to make changes to the minimum wage requirements. The employer most likely used the primary duty test in which they determined the primary duty of the job is not exercising in the gym,…

While IDEA is a federal law, it places the responsibility of providing a free and appropriate public education to the local education agencies and the individual states. In accordance with the 10th amendment, establishing and overseeing a public education system is a power for individual states. While IDEA contains guidelines for what constitutes a free and appropriate education (FAPE) for students with disabilities, it does not dictate how FAPE should be determined. It is the responsibility of the IEP team and local school agencies to determine what FAPE is for each disabled child.…

A recent issue that is becoming increasingly contentious and providing a hurdle to convergence between GASB and IASB is accounting for Financial Instruments. The financial crisis of 2008 had devastating consequences for the financial markets everywhere. Blame was widely spread and both IASB and GASB considered making changes in the accounting of financial instruments, particularly the delayed recognition of credit losses on loans. FASB and IASB began working together, but found irreconcilable differences in their solutions to this problem. Their main differences involved classification and measurement, recognition and derecognition and hedge accounting.…

Fuentes-Bautista (2014) expands on a participatory approach to municipal telecommunication that can lead for a sustainable adoption and use of the digital media. The case study of ChannelAustin presents a design of federal programs transmitted on broadband, becoming a transient solution to the long-term issues of advancement of local media. The multi-platform model and participatory approach states that cities should commit to using resources such as digital video franchising to retool the Public, Educational, and Governmental services and promote the advancement of residents using broadband as to demonstrate an active civic participation for creating digital PEG content. Findings suggest that digital community media projects similar to ChannelAustin…
