Florida Incest Case Study
Jamie should be charged with Incest, a 3rd degree felony under Florida law. Florida statute 826.04 defines Incest as: Whoever knowingly marries or has sexual intercourse with a person to whom he or she is related by lineal consanguinity. Because Jamie knowingly started to have sexual relations with his 14 year old sister Cersei since the beginning of summer and this violates our Florida statute, he is guilty of incest under Florida Law.
Jamie may not be able to defend his case because they are both blood brother and sister as we assume considering the facts given from the scenario , but if it comes out that she is not blood related, they cannot charge him with incest, but charge him with lewd or lascivious battery, committing a 2nd degree felony under Florida law. Florida statute 800.04 defines lewd or lascivious battery as engaging in sexual activity with a person 12 years of age or older but less than 16 years of age. Because according to Cersei, she claims that Jamie had sexual intercourse with her since the beginning of summer. In addition, Jamie knew her sister is a minor of age 14 and he is 23 years old.
Jamie should be charged with Lewd or lascivious molestation, a 2nd degree Felony under Florida law. The Florida statute 800.04 defines Lewd or

The Florida statute 784.045 tells us that aggravated battery is the intentional or knowingly causes great bodily harm or usage of a deadly weapon. Because the father was furious of Jamie sleeping with his own sister, he picked up a tennis racket and beats Jamie with intentions to hurt him causing bodily harm. But Jamie fought back, his father suffered several broken ribs, a punctured lung, and a broken jaw and Jaime only had some bruises, with that said, nothing can be done because he was just defending himself. Jamie’s Father is guilty of aggravated battery and Jamie should not be charged with fighting

    Even his own mother, Laurie had doubts at the end of the trial despite ridiculing at the absurdity when Jacob was first indicted. During the course, Laurie found out about Andy’s father and the idea of the “murder gene” which may have swayed her.
