The business owners of this case, Chris, Matt, and Ian, all live in California. They sell an aftershave lotion called Funny Face over the Internet, and contract this business through a company called Novelty Now Inc. that is based in Florida. The company Funny Face committed fraud by substituting a lower cost chemical emulsifier to increase the profit margin. This chemical is not FDA approved. A CEO named Donald Margolin bought a bottle of Funny Face on the Internet after hearing it marketed. This product turned Mr. Margolin’s face a permanent shade of blue and he filed a suit in the state of New York. The problem with this case is that the parties are from two different states. Being from two different states, the case could be brought in federal and state court. The website for Funny Face states that anyone who purchases their products can not take them to court and all disputes must be brought in the state of Florida. As stated previously, Funny Face committed fraud by substituting a lower cost chemical emulsifier, which is not FDA approved. Although Funny Face states on their website that Chris, Matt, and Ian can not be taken to court they still committed fraud by selling a product with ingredients not FDA approved. This product is sold on the Internet, meaning any one in any state can obtain it, which also means long arm statues will direct a lawsuit. If Chris, Matt and Ian did not want to be filed against they should have stated the FDA did not regulate their

Since 1945, technology has advanced to such a degree that it is possible for sellers to reach consumers in their homes worldwide. The onset of the Internet has created a lapse between the method of doing business in 1945 and the legal system's ability to keep up with technology. The "purposeful availment" requirement for the exercise of personal jurisdiction over a nonresident defendant ensures that it will not be haled into a jurisdiction solely as a result of a random, fortuitous, or attenuated contact, or by the unilateral activity of another party or a third person. In Quality Design, the court ruled that Tuff Coat's website was a passive one, whereby information about its product was provided, but actual sales were arranged via telephone or mail. The court found personal jurisdiction was lacking.…

Based on the information provided in the first hypothetical case problem in our text, if Javier decided to sue Energy-Auto Inc., Javier would be the plaintiff (the entity that is suing) and Energy-Auto Inc. would be the defendant (the entity that is being sued). Javier could sue in New York as our text states “… the action should be brought in the state with closer ties to the litigants or the subject matter of the action” (Rogers, 2012, sec. 1.2). He could also sue in Oklahoma, as that is where Havier was injured, so long as he provides due process (service of process). His injury in Oklahoma meets the minimum contact requirement for personal jurisdiction. “Minimum contacts may consist of doing business in the forum state, causing an injury there, or owning real estate there” (Rogers, 2012, sec. 1.2).…

A second jurisdictional factor that must be taken into account is that of subject matter. Subject matter jurisdiction is defined as “the power of a court over the type of case presented to it” (Kubasek, et al., 2011, p. 44). It must be decided if any of the above mentioned states even possesses the power to decide this particular case. It is also important to note that the concept of a federal court venue may not be entirely ruled out in this case, as the Funny Face product is marketed and sold nationally on the radio, in print, and through the Internet and social media (Southern New Hampshire University,…

The case involving Brandy Austin filing an action against Nestle in Hennepin County District Court in Minnesota for contamination of infant formula with Enterobacter saka-zakii bacteria should be transferred from a Minnesota to a South Carolina venue. This is true because when it comes to the location of jurisdiction for a trial, venue is concerned with the most appropriate location for a trial. The venue is to be chosen based on where it may be more appropriate or convenient to hear the case, and also in the geographic neighborhood where the incident occurred or where the party resides. In this case the venue should be changed from Minnesota to South Carolina because the alleged tortuous action on the party of Nestle occurred in South Carolina and also Austin is a South Carolina resident and gave birth to her daughter in South Carolina.…

Often times argumentative essays can be hard to read because a lot of the time they are stuffed with so much information, which is why adding humor helps keep the reader engaged and wanting to read more. Throughout Steven Colbert’s “Higher Education,” I found myself consistently laughing, making me want to continue to read to see what he says next. On the other hand, during Robert Applebaum’s “Cancel Student Loan Debt,” I found myself losing interest and almost dreading what was to come in the next paragraphs. Humor is a key component in arguments on topics that aren’t too interesting by themselves, such as Steven Colbert’s essay.…
