Legal Issues
Essay 2 Serving alcohol to underage students is illegal. Although in the incident of Ms. Mitchell’s restaurant the waitress that sold the underage girl alcohol did not do anything illegal. All the staff at Ms. Mitchell’s restaurant has been thoroughly trained when it comes to serving alcohol. All the servers were certified by the ABCC, and take an alcohol service training program each year. One night one of the waitress had a group of younger looking students so she checked the ID’s of the students drinking. She not only checked the ID’s but she checked them thoroughly. She verified the student’s age, hair color, general likeness, and absence of alterations to the ID card. On top of these verifications the waitress asked all the students to recite their birth dates, and addresses printed on the ID’s. After all the checks that the waitress had performed she served the guests each three glasses of wine in 90 minutes. On the way home that evening one of the guests that had been drinking got into a car accident and injured another person. The parents of this third party got an attorney and contacted the ABCC to contact the restaurant at fault. It turns out that the guest that caused the car accident was not really 21 but only 21. It is illegal to serve alcohol to anyone underage. But in this case the waitress is not at fault because she checked the ID’s of these students and they appeared to all be real. Unless the ID’s are obviously fake the waitress is not at fault for serving someone underage because they followed all the guidelines to selling alcohol and the customer appeared to be 21. The dram shop act in Massachusetts states that a business can be held liable if someone underage is over served alcohol and that person then commits an assault and battery or any other violent crime against another person. Technically though the person appeared to be 21 to the server and restaurant so they should not

Katherine "Flossie" Bailey, was a Hoosier leader for justice and equality. She was a Marion resident, Civil Rights leader and President of the Marion branch of the Indiana NAACP. She worked tirelessly - but unfortunately unsuccessfully - with the Indiana Attorney General in an attempt to bring the racist perpetrators of the heinous 1930 Marion Indiana lynchings of Thomas Shipp (age 17) and Abram Smith (age 18) and the attempted lynching of Dr. James Cameron (age 16) to justice. However, her work did pressure the Indiana legislature to pass a strong anti-lynching bill in March 1931. The Marion lynching was the last lynching in the North and the infamous photo of the heinous event inspired a Jewish NY songwriter to write the poem…

    Dram Shop Laws

Dram shop laws are instituted for all places which serve alcoholic beverages including restaurants, taverns and bars. An employee of these establishments may not serve alcohol to minors or those ‘visibly intoxicated’. If the person which consumed the beverage leaves the establishment, gets in an accident or causes bodily harm to another person, the establishment and the server may be held liable for damages. However, this should not be the case. Those who were intoxicated and caused the accident should be the only ones held liable for damages he or she caused to another person. Too many people take advantage of the legal proponent which allows these places which serve alcohol to be held liable.…

The current common law rule about duty of care of social hosts involving parties where guests bring and consume their own alcoholic beverages follows under the synonym of common law: general rule. In the case of Child V. Desormeaux, it was proven by the courts that the social hosts did not own a duty of care to the people injured by the defendant’s actions. “I conclude that as a general rule, a social host does not owe a duty of care to a person injured by a guest who has consumed alcohol and that the courts below correctly dismissed the appellants’ action.” The Supreme Court of Canada’s decision in the case of Child v. Desormeaux supports the current common law rule about the duty of care involving social hosts that they are no responsible…

Underage students are not going to stop drinking even if they aren't allowed in the bars (Jeffrey Patch 2/12/03). Most bars provide at least reasonable assurance that all customers will be drinking safely with staff members paid to keep patrons in line and police officers an earshot away (DI Editorial Board 9/25/06). Downtown establishments monitor the patrons' alcohol intake, use careful wristband systems, employ sober staff, and pay heavy fines if found to be serving to minors (Lindsay Schutte 10/1/04). Police records show that 93 percent of underage drinkers cited for possession of alcohol were ticketed at the bars (Drew Kerr & Nick Peterson 12/9/05). Irresponsible and underage consumers are hit where it hurts the most, their wallets, while responsible users are free from expensive tickets and fines. "We are not after underage drinking but rather binge drinking," said City Council member Connie Champion. "It is about the abuse of alcohol, not the consumption" (Jessica Seveska 10/19/04). Enacting a 21-ordinance in…

“Two eggs-wreck ‘em,” the waitress yells, “with an order of pigs, and shingles.” Most people wouldn’t have any idea that the person had ordered two scrambled eggs, bacon, and toast, but that is the beauty of jargon. Jargon is everywhere. Perri Klass describes her experiences with jargon in the medical field with her essay, “She’s Your Basic LOL in NAD.” In this essay she describes her feelings, both negative and positive, towards jargon and how it had become her “new language” (105). There are many consequences that can come from using jargon in a professional setting, such as enhancing teamwork, building professional and emotional distances, and creating an efficient workplace.…

1a.) Missouri House Bill HB 2081 establishes “Laura's Law” which specifies that any social host who furnishes a minor with intoxicating liquor found to be a contributing cause of resulting permanent personal injuries or death will be guilty of a class D felony. This law changes the dynamics of any old law (alcohol-related traffic offenses, with penalty provisions) by holding a person who has control over the consumption of alcohol by a minor is now referred to as the “social host”. The social host (parent, guardian, or other adult) who has exclusive use and enjoyment of any property, (licensed retailer, club, drinking establishment, or caterer or holds a temporary permit, or an employee thereof; selling the intoxicating liquor to the minor with reasonable cause to believe that the minor was twenty-one or more years of age; and to purchase the intoxicating liquor, the person exhibited a driver's license, Missouri non-driver's identification card, or other official or apparently official document, containing a photograph of the minor and purporting to establish that such minor was twenty-one years of age and of the legal age for consumption of intoxicating liquor) accountable for the minors actions if and while intoxicated. The reason I believe the bill was introduced is most likely a young girl named Laura had been mortally wounded while being intoxicated, and being “over served” was the mitigating factor. I would also speculate the incident turned political as the bill was introduced by Representative Noel Torpey, whom was also running for political office.…

It was easy to tell they had a little too much to drink. One of the men came out with a bar stool on his head. At the time this seemed like a hilarious stunt, but in the end it turned out to be no laughing matter. Upon stumbling out of the bar, the man was confronted by the doorman for not paying his tab. Things escalated quickly and punches were thrown. Within minutes police were on the scene and the man was handcuffed and on his way to jail. Even though I was just 14, I saw the potential result of that one foolish decision. It made a lasting impact on me to look at the unintended consequences and to really examine and think about situations and…
