Gucci: What If The Facts Were Different?
What if the facts were different?
If Gucci had not hired a private investigator and presented evidence, the court had not had personal jurisdiction over Wang Huoqing. Because the court has jurisdiction over corporate defendants that do business within the state. The person must have had minimum contacts with a citizen of the court’s jurisdiction. (page#34)
The legal environment dimension
It didn’t matter where Gucci’s principal place of business was located. Because the court was using the minimum contacts and jurisdiction may be exercised over out- of- state defendants under state long arm statutes. (page#34)

It might be argued that there was no agreement between Gimbels and DiDomenico. It also might be argued that DiDomenico would be acting on behalf of Gimbels and that he had the approval of Gimbels to oversee and direct the manner in which his surveillance was to be conducted. The case states that DiDomenico had followed Mapp into Gimbels when he was actually working for J.C. Penneys. It also does not state that he was invited by Gimbels to assist in the pursuit. Only that he remained there without invitation and at his own instance. His assistance was neither requested nor sought by Gimbels or by anyone on its behalf. So it appears that DiDomenico was acting on his own behalf and not as an agent or employee of Gimbels when he chased Mapp through the parking area and apprehended him in the lower parking area. There is no evidence for the belief that there was an agreement of between Gimbels and J.C. Penney for assistance. Nor was there any evidence that the security service of one store was authorized to provide security service to the other store when apprehending shoplifters.…

Based on the information provided in the first hypothetical case problem in our text, if Javier decided to sue Energy-Auto Inc., Javier would be the plaintiff (the entity that is suing) and Energy-Auto Inc. would be the defendant (the entity that is being sued). Javier could sue in New York as our text states “… the action should be brought in the state with closer ties to the litigants or the subject matter of the action” (Rogers, 2012, sec. 1.2). He could also sue in Oklahoma, as that is where Havier was injured, so long as he provides due process (service of process). His injury in Oklahoma meets the minimum contact requirement for personal jurisdiction. “Minimum contacts may consist of doing business in the forum state, causing an injury there, or owning real estate there” (Rogers, 2012, sec. 1.2).…

    Adnan Syed's Case Study

But, what the defense failed to bring to the court's attention is that on a fax cover sheet discovered by Susan Simpson, AT&T clearly states that incoming call information is not reliable for location of the phone, negating the prosecution's use of it being a tracking device for Adnan. Those AT&T records said Syed’s phone “pinged” a cellphone tower covering the park and nearby areas during calls he received at 7:09 p.m. and 7:16 p.m. on 13 January 1999. The calls were described by Syed’s current attorney as “the pillar of the state’s case” against him. In a court motion filed last August, Syed’s attorney, C Justin Brown, said the disclaimer should have barred prosecutors from using the cellphone records. Brown said the misuse of the records in the face of the “unambiguous warning” on AT&T’s cover sheet – and the failure of Syed’s original lawyer to do anything about this, amounted to prosecutorial misconduct and a denial of Syed’s right to due process. Although this evidence seems crucial to the case, Adnan's lawyer never brought this up at trial, one may think that his lawyer may not bring the evidence to trial is because the state didn’t present them the evidence. Also, in Jay’s interview with Intercept he states that the burial took place at midnight, making any significance the cell records had in placing Adnan near the burial site at seven p.m.…

Chapter 4 – Case StudyJay Z the Rap Artist and Business Mogul: His Rise to the TopPlease read Chapter 4's Case Study on pages 116-118 and answer the following questions: 1. As mentioned in the case, Jay-Z wears several hats with respect to the several business ventures he manages. What does this say about his time management skills? Time management means techniques designed to enable people to get more done in less time with better results. Jay-Z is known for multitasking. In the text it says research has found that people who multitask are actually less efficient than those who focus on one thing at a time. This was not the case for Jay-Z. Jay-Z took multitasking to a new level. He had many accomplishments including his musical career, co-owning the 40-40 club, partially owning the New Jersey Nets, and creating Rocawear. He also was the CEO of Def Jam Recordings, a founder of Roc-A-Fella Records, and the founder of Roc Nation. He also changed the face of Hip-Hop from baggy to dressy. What does this say about his time management? I would say that this says Jay-Z took time management and put a new face on it. He showed that he knew how to manage things while multitasking and become a very successful person. He analyzed his time well and showed that nothing is impossible. Not even multitasking. He knew his priorities, objectives, and plans and he scheduled them perfectly. 2. Step 1 and 2 in the career planning model are self-assessment and career preference and exploration. What in the case will support the possibility that Jay-Z implicitly did a self-assessment before launching into a music career as a rapper?Jay-Z has always had a sense of his career preference. When his mother got him the boom box and he discovered how well he liked music he put it in his head that he was a entrepreneur just like other successful rappers. This showed that viewed himself as successful.…

Generally, this power only covers a specific geographic region. For example in the state court system, a court's in personam jurisdiction usually extends to the state's borders, whereas a federal court exerts power over a greater area (Kubasek, Browne, Giampetro-Meyer, Barkacs, Herron, Williamson, & Dhooge, 2011). Because this case involves multiple parties from multiple geographic areas, the statutes regarding in personam jurisdiction must be scrutinized for all three states involved (New York, California, and Florida) before a venue may be decided upon.…

Personal jurisdiction “is defined as the power of the court to hear and determine a lawsuit involving a defendant having some contact with the place the court is located” (Kubasek, N. 2012). The business owners of this case, Chris, Matt, and Ian, all live in California. They sell an aftershave lotion called Funny Face over the Internet, and contract this business through a company called Novelty Now Inc. that is based in Florida. If I was the judge presiding over Gampero's case I would have acted professional, and honorable. Judge force Charles Gampero J.R into accepting a plea bargain by using his position over the courtroom to influence his choice. I would have not told a man if he was found guilty, I would give him the maximum sentenced of 25 years. United States of America is innocent before guilty, and judge Francis Egitto demonstrate behavior that was unconstitutional. In my opinion, I would have not assume the man was guilty, but innocence because as a judge I took a oath to be a servant of the courtroom. Additionally, individuals such as judges must take a neutral stand against information, until it has been proven in court. This to me is truly a professional,…

    * Personal jurisdiction is, in general, determined by the residence of the parties. A court has personal jurisdiction over a case if the defendant is a resident of the state in which the court is located. In such cases, the determination of personal jurisdiction is straightforward. However, an out-of-state person or corporation can also voluntarily submit to the jurisdiction of a particular state court by agreeing to do so in writing or by taking certain actions in the…
