Megan’s Law is named after a 7-year-old Hamilton Township, New Jersey girl named Megan Nicole Kanka. On July 29, 1994, she was lured into her neighbor’s home with the promise of a puppy and was brutally sexually assaulted and murdered by a two-time convicted sex offender who had been convicted in a 1981 attack on a 5-year-old child and an attempted sexual assault on a 7-year-old. Sparked by community outrage, petitions began circulating throughout the state of New Jersey demanding the right to be made aware of sexual predators. Megan’s parents, Maureen and Richard Kanka, had gathered more than 430,000 signatures, and 89 days after Megan’s disappearance the first state law that mandated active community notification was signed into law, New Jersey’s Megan’s Law.…

In light of several tragic events leading to innocent victims of sex offenses, namely that of Megan Kanka, laws mutually known as Megan’s Laws have been established mandating sex offenders to register their locations of residence and employment to alert those in the vicinity to exercise caution. While these laws have been known to generate awareness of sex offenders, they also have been known to cause more harm than good. The laws allow for public roasting of the sex offenders, deterring them from moving on and somewhat enabling them to commit a crime again. Not to mention the costs associated with these laws are quite steep, although it is not possible to put a price on one less victim of a sexual offense.…

For example Rapist hurt their victims, normally forcing them to have sex by threatening them with an object or threaten to harm someone they love if they don’t apply with what they are saying to do. Frank didn’t force Nikki to do anything, he didn’t threaten her in any way it was a mutual agreement to have sex between the couple according to Pesta “[Nikki] told the [officers] the sex was consensual.” Another example is when a rapist and pedophile commit their crimes its illegal in every state no matter their age when the crime is committed unlike with Frank and Nikki it was only against the law because the age she was and the state they had sex in. Because the age varies in different states, it can be a crime in one state and not in another. But with rape or molestation it is illegal not matter our age or what state you committed the crime…

Changes to society Sometimes the punishments could traumatize the accused, which leads him to harm the society. Such as law 48, maybe the man thinks making an trench and planting is more than enough work. Thinking that this is unfair Other times the accused could be useful to society, but instead they punished him to no longer be useful. In law 218, a highly skilled surgeon got the luck of trying to save a person that damaged almost all vital organs, now the surgeon fails and loses his hands. Without hands the surgeon can not operate, and he can not of save hundreds of more lives .…

Thousands of people are sexually abused every year, however not all sex offenders are ever apprehended. There really is no description as to who is a sex offender as they can seem normal and be highly intelligent. They have been known to premeditate and to use deceptive techniques to get what they want (Crosson-Tower, 2008). Many believe that sexual offenders should be monitored for the rest of their lives because statistics show that they are likely to repeat their first offense and to ensure the safety of society.…

“In July of 1994, Jesse Timmendequas, a convicted sex offender, raped, beat and strangled Megan Nicole Kanka. This sex offender lived across the street from the Kanka family; however the family was never aware of this.” (www.mapsexoffenders.com) This event brought about the ongoing controversy that is whether or not to give out information on sex offenders. The Kanka family decided after the murder of their daughter, something had to be done about the lack of knowledge of the residences of sex offenders. The family and over 430,000 other people signed a petition to get the names, addresses, and personal information of registered sex offenders out there for the public to observe. These terms were eventually turned into laws called “Meagan’s Laws.” Each state maintains an online registry of all the registered sex offenders in the nation. These websites contain maps where a user can enter street names, city names, state, and zip codes to look up sex offenders. Some websites even provide pictures along with the names and addresses of the offenders.…

Sexual assault offences are the least reported crimes in NSW, with only 15-20% being reported in 2004. Out of the reported offences, an estimated 2% were convicted. Even being compared to all other categories of crime it is a small conviction rate. These conditions gave rise to the need for law reform, and research into why both the rate of reporting the crimes, and the conviction rate were so low. ‘Why Sexual Violence is Almost Legal’1 gives an insight into the delay and lack of convictions in this area. Research found that many victims believed that they wouldn’t win their case, and so they didn’t report it. In 70% of the cases, the offender is known to the victim which makes the proof even more difficult. This is because the case is usually replying on one person’s word against the other, unless there is convincing physical evidence. Physical evidence for this also needs to be examined, which is an issue if the…
