The diagnosis of the problem stems from the fact that honor code was a rigid book of rules that all cadets were expected to adhere too. All parties guilty of violations were given the harshest punishment of expulsion. They were 100% aware of what was involved and consequences of actions if violated. One of the issues the military is having is that there is no real way of tracking hazing or tracking when hazing takes place. According to the military law center, "In the military, sexual harassment accusations are taken more seriously and prosecuted more ferociously because the military holds service members to a higher ethical standard." The United States military takes any form of sexual offenses as very serious and those who participate in the act are punished with jail time and a lifetime registration on the sex offender registry where ever the individual is located. All individuals are innocent until they have been proven guilty of the act of sexual harassment in the military. Once the attacker is found guilty, he or she may be dishonorably discharged, dismissed from the armed forces, as well as the confinement in a military prison. They may also be face other charges given to them by the military, such as conduct unbecoming of a member. In the different branches of the military there are a few different programs that help educate those of the armed forces on how to prevent sexual harassment and keep themselves from being accused of the act. In the army, the name of that program is SHARP. The SHARP program is responsible for educating everyone in the military on what sexual assault/ harassment is, the three different categories of sexual harassment, how an individual may help themselves or someone else who is a victim of harassment, as well as providing and helping victims file complaints when need be. One of the first reasons sexual assault in the military should be severely punished is the story of Michael Matthew’s story. The film illustrates Michael’s story in great detail. It is terrifying. He was a man in the Air Force victimized by the licentious acts of these sexual assaulters. Michael was raped by two men while he was on duty. Michael went through several failed marriages. One of the most effective ways to help prevent hazing is simple: education. According to one source, within the military, the Office of Hazing Prevention has begun to take steps to not just track hazing, but to help eliminate it entirely (Klimas). In Louisiana state law, hazing is defined as a physical and mental crime and is classified as a misdemeanor. Some of the language in the statue is rather vague and ambiguous, thereby granting an easier defense for the accused. Louisiana’s statue prohibits behavior that could “reasonably be expected to result in great bodily harm.” The wording in Louisiana’s law makes it probable that hazing would be more challenging to concretely prove. Students who are being charged with hazing crimes are increasingly relying on this defense. The best definition of a rite of passage is a ritual event that marks a person’s transition from one status to another. This can be in many different forms, some being a lot more extreme than the others. In the United States rites of passage seem to be a lot less extreme than in other cultures. When most people think of a rite of passage around here it’s usually a Sweet Sixteen party, a marriage, or a funeral. Although those are the main ones there are still some that are very common but a lot less known as a rite of passage. If you were ever in any sports growing up I’m sure that you’ve at least heard of hazing if not actually been a part of it or seen it happening. Hazing is type of Rite of Passage when you’re new to a team that happens in all levels of athletics from little leagues all the way up to the professional level. Insubordination is defined as when someone refuses to obey an order given by a person who has more authority than them. As stated in the UCMJ ,any warrant officer or enlisted member who, (1) strikes or assaults a warrant officer, noncommissioned officer, or petty officer, while that officer is in the execution of his office; (2) willfully disobeys the lawful order of a warrant officer, noncommissioned officer, or petty officer; or (3) treats with contempt or is disrespectful in language or deportment toward a warrant officer, noncommissioned officer, or petty officer while that officer is in the execution of his office; shall be punished as a court-martial may direct.
