The facts in the case of Thompson V North American Stainless, LP 562 U.S._ (2011) are fairly straightforward. The petitioner in this case, Eric Thompson, was seemingly fired from his job at North American Stainless (NAS) because his fiancée, Miriam Regalado filed a sexual discrimination charge with the Equal Employment Opportunity Commission (EEOC). His suit was filed under Title VII claiming that his dismissal was retaliation for his fiancée’s charge. (Pagnattaro, Cahoy, Magid, Reed, & Shedd, n.d.)…

In her open statement on the sexual harassment hearings, Anita Hill recounts the details of how Judge Clarence Thomas took advantage of working relationship between them and conducted inappropriate sexually offensive behaviors toward her. Although Hill does not feel comfortable to reveal her vulnerability, she keeps a very formal and constraining tone while she illustrates in details of the process in which Judge Thomas intentionally ignored her refusal on his innumerable invitations to social outings. Admitting to having poor judgement, Hill is still trying to portray a despicable and heinous character of Judge Clarence, and proves to the court that his illegitimate action deserves punishment.…
Dr. Takem uses the information gained in sessions with her patient Sam to charge an upgraded fee. Prior to learning about Sam’s inheritance the fee schedule was $45/session. After learning the additional information about the sizeable inheritance, Dr. Takem changed the fee schedule to $125/session. Her reasoning behind this was “the fee needs to be high for him to perceive the therapy as valuable and worth his effort and time”.…
As it relates to harassment, which is “when a person purposely and without legitimate purpose, has personal contact with another person, with the intent to threaten, intimidate or alarm that other person” (State v Evans, 2003). Evans claimed that at no time did he threaten Arnold he only wanted her to take pictures. The courts advised that threaten the victim is not a necessary element of the harassment statute. However, there is substantial evidence that proves Evans intended to alarm or intimidate Arnold. Starting with when he showed up to her home uninvited on August 31 and asking her to play a dominant role in a picture. Evans behavior would easily cause Arnold to feel frightened or in danger. This act was proven when Evans showed up to Arnold’s home in women’s shoes with red toenails. This behavior would be alarming and bizarre. The elements of stalking were met when Evans continued with his persistent questioning which was sexual in nature. This conduct continued with the unexpected encounters at Arnold’s home. Evans purposely engaged in the course of conduct that would reasonably put in person in fear of bodily injury. Evans behavior began to escalate in which Arnold she had to flee from Evans. Given Evans repeated attempts to photograph Arnold, her immediate refusals and the bizarre sexual nature of…
In 1993, Ruth Bader Ginsburg, a Columbia Law School, Cornell University, and Harvard Law School graduate, became the second woman to ever be given a position in the Supreme Court. Born into a low income family in Brooklyn, New York on March 15, 1933, Ginsburg was frequently exposed to gender discrimination throughout her college years—as there were “only 8 other females in a class of 500 students” at Harvard Law—as well as in the work force. This ultimately pushed her to fight for gender equality. She began her career as a clerk and then teacher, becoming Columbia University’s first tenured teacher who was a woman. Following this, she took on several projects in which she fought for the rights of woman in front of the Supreme Court of the United…
AbstractThe Army uses all four functions of management through a Chain of Command. All leaders throughout the military use at least one function, but multiple leaders working together covers all functions. Always someone is planning, organizing, leading, or controlling. The reason the United States Military is so effective is because leadership and management always try to stay a step ahead. The rank structure provides a guideline to how much a soldier manages. More rank brings more responsibility, more respect, and more use of each function. Though not all functions are needed to be a manager, a good manager does need all four. The Chain of Command is the best example to show leadership, management, and the four functions - plan, organize,…
In my opinion, firing Allen Lopez from the company would violate his civil rights. Allen’s view and action are based upon the consequential theories. He put his career at risk by creating a website to protect his co-workers human rights due to unfair work condition. All employees should be treated equally regardless of their gender, color, age, physical disabilities, and race. He created the website, because he feels that his co-workers rights were violated. The fact that he raised his concerns to their superior, so without any resort he created a website that has a direct reflection of ExtremeNet. Employees have the right to voice complaints about their employment condition in a public forum without consequences. “What you say must have…
Title IX is a federal law that prohibits any discrimination on the basis of sex and gender under any educational programs or activities that receive financial assistance. I believe that the intent or motive behind Lewiston’s conduct should be considered when deciding sexual harassment activities. According to the EEOC, the commission will consider sexual harassment complaints on a case-by-case basis. In addition, all aspects of the incident will also be considered. While the actual conduct of the harasser will be an important factor under consideration, the purpose or intent behind the actions will enter into the investigation of the case. Incidents were no severe harm and intended will be evaluated…

In this case, I saw there was sexual harassment by creating a hostile environment for Mrs. Beverly Gilbury by Mr. Peter Lewiston. Mr. Lewiston created this environment by spending more time at her classroom, sending flowers, letters and appearing at her car. Mrs. Gilbury frequently told Mr. Lewiston that they were friends. The initial injection for sexual harassment by the victim is valid but I’m shocked that she didn’t appear for the appeal.…

She believes that the gender inequality gap should disappear, which means she believes should be treated equally when in criminal matters. Henceforth, anti-harassment laws will be likely applicable on both genders, as will their sanctions. Currently harassment sanctions are more powerful for those regarding the harassment of women that those regarding the men. Therefore, criminal sanctions on women should be equally as powerful as those on men.…
